ILR from combination of Tier 2 and Tier 1

Post by hshokouhi » Tue Dec 30, 2014 5:41 pm

Hi,

I'm currently holding tier 2 visa and will be eligible for ILR on September, out of this 5 years i had 2 years tier 1 first and then switched it to tier 2. Should i provide any documents from my tier 1 period or my last tier 2 payslip and bank statement is adequate?

Thanks

ILR after 7 years

Post by hshokouhi » Thu Jan 01, 2015 3:27 am

Hi,

I know my question sounds stupid but If someone initially got tier 1 for 2 years and then tier 2 for 3 years, is it possible to extend tier 2 and apply after finishing 5 years tier 2 and totally ignore the initial tier 1 period?

Thanks

Yes, provide documents from Tier 1 period.

The reason i'm confused is a Section 11L of the application, because my last grant is Tier 2 but had tier 1 first so it refers me to section 11L and then there are two questions there

1. Documents from section 9A which is a main Tier 1 section

First confusion is this is my salary level, when I initially got my tier 1 in 2010 i was an IT consultant and my salary was enough for Tier 1 but then I decided to change the career so there was a drop in my salary and that's why i switched to Tier 2 because i wasn't eligible for extension anymore and based on section 9A i can't get enough points for that period.

2. "For the period before you were granted leave as a Tier 1 (General) migrant, documents showing that you met the relevant requirements of the immigration rules."

And what should i provide for this ? Is it enough to provide letter of approval or I should provide all my first tier 1 application documents again?

You should satisfy 245HF, also subject to the General grounds for refusal (245HF(b)).

For the time you had leave under Tier 1 (General), I think that it may be sufficient to show that you meet the conditions of Tier 1 (General) (245CB).

So does it mean i should extend my tier 2 for 2 more years and then only apply based on my 5 years tier 2 ?

No, it does not mean that.
