Hi
I came to uk from india on hsmp earlier in 2008 which is now tier 1. i got my extensions done .got my ilr done in same day service on 14-05-2013.the problem is when can i apply for naturalisation becoz i was away from country from july 2013 to july 21 2014 was on holiday for 2 months couple of times during my stay from 2008-2013. how is the rule 0f 450 days out of contry be considred . is it strict in consideration about the days? .not more than 90 days in 12 months period from grant of ilr? can i apply inapril or may 2015 or need to wait till july 2015 till i finish a year after my come back from india after a year holiday.
Eg:can i calculate or consider that if i am in may 2015 and take 5 years back dated it comes may 2010 and calclaute 450 days from may 2010 -may 2015 if i dont cross i can apply ? where 5 years criteria will be met and 12 months after grant of ilr and not more than 90 days out of country in 12 months. plz suggest.. thanks in advance

You should not have been absent more than 90 days in the final year and if absent for more than 180 days in the final year it will most certainly lead to your application being refused even if you apply for discretion.
Have in mind that for the year that you have been absent you must have been UK resident all the time.
I am sometimes wrong.

thanks for the reply .

can i apply in may 2015 as it will nearly 2 years after getting ilr and was not more than 90 days away from uk.will be 9 months after come back to uk .is that fine as it will meet that inlast 12 months u r not more than 90 days . or i have to strictly stay for a year from date of arrival .i.e july 21 2014 to 21-07-2015 to meet resident requirement and than apply.will no of days of absences considered more than 450 days in total 5 years .if i consider i am applying july 2015 and check n consider dates for 5 years back dated will be july 2010 -july 2015 in these 5 years the no of absences are 478 days already .will it be considered more absences as i have entered in uk first time in august 2008.

In the last year should not have been absent for more than 90 days. In the last 5 years you should not have been absent for more than 450 days in total.
Anything above that and you would have to apply for discretion (as I did).

My husband and I first entered UK on 23rd December 2008,My husband as main applicant Under Tier 1 visa and I as dependant, ( please note my visa was Not spouse visa ) I registered and left the country and returned back to UK on 6th January 2011.Effectively I was here for 3 years and by January 2015 when My husband wants to apply for naturalisation it will be 4 years for me to be here continuously.

We both received our indefinite leave to remain on 12th December 2013.

My husband is going to apply for naturalisation on 12th December 2014,

There are 2 questions:

1. Would I be able to apply for naturalisation same time as my husband which would be 12th december 2014 under joint application or would I have to wait until its 5 years ? ( per home office official website on naturalisation guidance , If Im married to non british citizen I shall wait 5 years before applying for naturalisation)

2. If I wait for my husband to get his naturalisation which I would assume it would be by some time in march 2015 will I be able to apply then and use 3 years residency requirement as spouse of british citizen ? Would my husband classified as british citizen ?

1. If you have been resident for the last 5 years, had ILR for one year and haven't been absent in total for more than 450 days in the last 5 years and not more than 90 days in the last year than you can apply.
2. If you have been resident for the last 3 years and have ILR you can apply the same moment your husband becomes British citizen.

i understand that i should not be more than 450 days of out country in 5 years and not more than 90 in the last year before naturalisation .but my concern is can i apply for naturalisation in may 2015 as i have got my ilr in may 2103 and was away from country from july 2013-july 2014. as u have sent a pdf which gives days of absences information . can i apply for naturalisation as i am in country for more than 5 years .2008-2015 will be 7 years can days of absences be considered accordingly...

You are allowed to be absent for 450 days in total in the last 5 years and 90 days in the final year. Anything above that and you would have to apply for discretion.
You have to calculate how much traveling you will be doing but as things stand you can apply in May as you will be under 90 days in teh final year.

hi

do u still need to prove the English language eligibility or the UK naric certificate as i have already passed life in uk and used it for getting ilr done in may 2013.i have proved English eligibility claiming points in Hsmp calculator for tier 1 extension and Ilr done.i have got a medium of instruction certificate as english for my bachelors degree and masters degree done in India which is accepted for iLR. do i still need a ielts,b1 English or etc for naturalization applying in may 2015.

Form AN states:
I met the knowledge of language and life requirement to qualify for settlement on or after 28th October 2013;
So if your ILR is before that date, you need to provide KOLL proof.

thanks for the reply . i have got life in uk got passed and done my ilr in 2013 may .so do i need to do the English eligibility test or the medium of instruction used while getting ilr in points based calculator will be helpful.
