Uk Ancestry: South African adopted by British Stepfather

Post by MrsMoosie » Wed Feb 11, 2015 8:52 am

Good morning everyone!

I'm writing this on behalf of my cousin, who would like to relocate to the UK with her fiance (soon to be husband in September). My cousin is South African, and her fiance is also South African, but was adopted by his step-father when he was 2. His step-father is a British Citizen. His step-father and mother have since divorced, but he remains adopted by his step-father.

By definition of UK ancestry law, would my cousin's fiance be entitled to a UK ancestry visa? I know that the rules state you can't claim UK Ancestry via step-parents, only if you are adopted (or your parent was adopted) by a British citizen, but would like to just get further clarity in this situation.

Advice gratefully received!

Thanks,
Carmen.

Yes, he should qualify and would need all the relevant adoption paperwork, which if he doesn't have is not so easy to get from Pretoria.

My mother was adopted by a British mother and SA father when she was 3 and I have and my parents have used the Ancestry route to the UK.

Thank you so much for your advice - that is great news! I believe he has all the required documentation, but will just check. Will he need British grandparents birth certificates too, or just his stepdad's?

Thanks,
Carmen.

He will need the following :

Grandparents unabridged birth certificate (easy to obtain in the UK)
Grandparents unabridged marriage certificate
Adoptive parents full unabridged birth certificate
Parents unabridged marriage certificate
His unabridged birth certificate post adoption as his details will have changed
Copy of the court papers for the adoption
Your marriage certificate once you are married

Roughly R30,000 each, held for minimum 3-6 months with a non-decreasing balance.

Proof of work intention in the UK

Proof of accommodation in the UK

You are a star. This is very helpful. On the proof of accommodation, they will be staying with my husband and I. Can I provide a letter stating that they will be living with us until they manage to find suitable accommodation - would this be sufficient?

Again, thank you!

A letter from you, called and invitation letter, is fine and you will need to include a copy of your council tax and another utility bill. The letter will need to stipulate both your names and both of their names and dob details etc.

Grandparents marriage certificate might not be needed as claiming ancestry through male line but always best to be prepared.

You're welcome Carmen.

Shout if you need anything else. I have a document map my immigration advisor did for submission from when I did mine back in 2008 if your cousins feels this will be helpful considering I also used the adoption route.
