ESOL Examination for FLR(M) and Cohabitation docs

Post by n8net » Sun Mar 08, 2015 7:53 am

Hi

I will be applying for ILR soon and since my wife who has only been with me for a year on Tier 1 G depednedant
visa, she will be applying for FLR(M). I have got two questions and expect some advice from you guys.

1. She has taken a ESOL Entry 2 exam back in 2011 and got A2. is that ok for FLR(M) ?

on the certificate it says its been awarded by University of Cambirdge (www.cambridgeesol.org) but
as per https://www.gov.uk/government/uploads/s ... tional.pdf
it says Cambridge English Language Assessment as as accepted body.. is that ok ?

2. for cohabiation doc, do I need to submit proof from two sources ?
I am planning on submitting Marriage Certificate + Council Tax + (tenancy agreement - optional)
will this be enough ?

thanks

For FLR(M), English A1 is required. As you have English at A2, this is higher so should be fine.

As for cohabitation documents, The requirement is evidence from at least 3 different sources over the 2 year period. You need a minimum of six documents in joint names (or one document in each name if you don't have them in joint names) spanning the 2 year period.
Six items of correspondence addressed to you and your partner at the same address as evidence that you have been living together since your last grant of leave in this category, or from the date you first started living together up to a maximum of two years. See Note 9.

Note 9 The items of correspondence should be addressed to you jointly or in both your names. Examples of acceptable items are listed below. The documents provided must be originals.
Photocopies are not acceptable.
The dates of the items of correspondence should be spread evenly over the whole 2 years. They should be from at least 3 different sources. If you do not have enough items in your joint names, you may also provide items addressed to each of you individually if they show the same address for both of you.
For example - Four items of correspondence in joint names to the same address and two items addressed to each partner at the address. In total eight items would need to be submitted.
If you and your partner have no bills or correspondence in joint names, you will need to submit twelve items (six each) of correspondence, evidencing that you reside together at the same address.
If you and your partner lived with relatives or friends for some or all of the 2-year period, please provide a letter from the relative(s) and/or friend(s) confirming this.
If you did not live together for any part of the 2-year period, tell us the reasons for this and whether you stayed in contact with each other during this time, and provide any relevant supporting evidence.
Please give an explanation on a separate sheet if you cannot provide six items; if the items are not addressed to both of you; or if they do not cover the 2-year period.

Hi
I want to apply for my wife flrm. I am a bit confused on the 2 years period of living together. My wife has come to UK in November 2011. I am going to apply for her flrm in April 2015 so this means that I need to provide 2 years documentation from April 2013 to April 2015. As we do not have any thing on joint names so we need to provide 6 documents each. Her very first document that I can provide for the 2 year period is her NI letter dated April 2013. Rest of her documents including bank statements are from July 2013 onwards. There is not a single document that is from April 2013 to April 2015. We have 6 documents for her like her home office letters, credit cards and bank statements, doctors letters etc. My understanding is that the 6 documents need to cover the 2 year period even if one documents is from April 2013 and the other is from August 2014 etc. Some body told me that all 6 of her documents should cover the 2 year period each. For example if she has a barclays account then it should be from April 2013 to April 2015 and same for the other 5 documents. All her documents are from a different period of time in those 2 years as some of her credit cards and banks accounts have been opened approx 8 months ago. But for each month of those 2 years we have a document each for her to cover it. Kindly help me.
Thanks.

I am getting really confused here.

is FLR(M) only applicable to those hv been in the UK for 2 yrs or more ?

what do PBS dependant who have been in the UK for less than one yr do when
the main applicant applies for ILR ?

is that case what docs need to be submiited ?
