Ancestoral Visa with a Twist

Post by BradDC » Thu Sep 27, 2007 11:15 am

Hi Guys,

Im a 22 year old South African guy, I have been over to the UK on a 2 year working holiday visa and returned to SA last year July, I traveled over with my mother and little sister, however couldn't find a way of staying, though despite being qualified and going for multiple job interviews, the prospect of a work permit scared most employees off.

However my Mom naturalizes this year and is going to be getting married to a UK citizen next year ( yes, she found one who meets the grade and I dont want to despatch of ;)

My Mom qualified for an ancestral visa, but I was 19 at the time no longer qualified. Now that she is going to naturalize and is marrying a UK citizen, does this change my eligibility for an ancestral visa for myself?

Any advice would be most welcome.

Once you are over 18, having a mother who becomes a UK citizen doesn't help unless you are in desperate circumstances at home, I'm afraid.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

Hmmm... ok. does this change at all if my parent is married to a UK citizen?

Same answer. Once you hit 18 or above, it is very very difficult for your parents to bring you into the UK as a dependent.

The ONLY exception is the EEA route - does your step-father have any other EEA nationality (e.g. Irish)? ALTHOUGH this is very hard to prove aswell, so don't get your hopes up.

If he is only British, there's no chance. What are you currently doing? Working, studying? Are you married/with kids? What has happened to your little sister?
