URGENT HELP NEEDED !!!!!!PLEASSEEEEEE

hi,
me and my business partner applied for tier 1 entrepreneur visa in oct2013, refused in around may 2014, appealed and appeal was hear in ftt in feb 2015, appeal not allowed, applied for permision to appeal to UT in FTT on 31st of march, we received acknowledgement letter from tribunal. after that we kept on waiting till today, 2 days ago capita started calling me and my friend about our status and bells started ringing for us that what is going on as we were still waiting to hear back from FTT for our permission to appeal to upper tribunal. however, in curiosity i contacted tribunal services today and they said that they have sent out refusal letter on 11th of june which none of us, me my business partner and our solicitor have received so we did not know that our permission to appeal is refused. i contacted tribunal services again and they notified me that our solicitor should contact them, solicitor contacted them today and tribunal asked him to fax everything in writing that we did not receive the decision letter and request new decision letter. he faxed them in writing today. now i am dying in tension as we did not have any intention to be overstayer but under current conditions:
1) are we overstayer now?
2) what would home office do to us, come at our places to detain us?
3) our passports are with home office and are also expired 2 months ago so what would be our options.
4) solicitor said that id we did not receive the letter, its not our fault, we should get new copy and appeal to upper tribunal with delay grounds based on not receiving the letter.
I need sincere advise from forum pros and specialists please.
please help me as i am dying with anxiety becasue i am a person who abide the law very well but this time without our knowledge this happened to us.
i am a skilled person and i fear of losing my chances to go to canada or australia if i get overstay status sticked to me here in the UK.
please help

Hi there,

I can understand your situation, please do not panic, focus on yourself what are you doing does it fit with the purpose of obtaining Tier 1 Entrepreneur, as long as you have done genuine work to run a business, to grow it, and have sustainable evidence to prove everything you have nothing to worry about. I know this advice will not help as much and you may still spend some sleepless nights, but please try to focus on the purpose visa is a document which should be an end result of your efforts not a memo for the beginning of new journey. Specially in circumstances you are in and with the timing so adverse only thing you can do is get organised and do what is intended not what situation is forcing you into.

First of all sorry tk hear about what happened.
However please do not worry about capita, they are doing there duty. Your solicitor can easily deal with them. As long as you are in the legal process of fighting your case they can't do anything to you. So try to focus and apply for utt and you should be fine.

Hi,
thanks a lot for your reply guys.
to be honest i am not worried about the fact that i would have to leave uk coz i have not been granted visa. world is an open horizon for me in terms of going anywhere.
only problem and issue i am worried about is i dont want to be treated as a criminal by home office guys as it was not our fault that none of us, me my friend and solicitor received the letter which is quite strange and i only knew about it when i called the tribunal today.
they served decision on 11th of june, today is 16th of july which means i am about 5 days overstayer now.
tribunal asked my solicitor to fax them in writing about not receiving the decision and they will send out the copy.
so my only worries about overstay purpose and home office people making my life difficult here for upcoming days.

i think you may have few more days, as you know you can apply second application with 28 days. just check when the decision was made by court........
