Applying for spousal visa using saving

Post by TH20051992 » Mon Sep 28, 2015 2:59 pm

Hi
I recently got married back in July 2015 in Shanghai to my wife who I first met 4 years ago at university. I am currently in process of completing a master which I will finish in January and the plan if for my wife to get a visa in March. The issue however since I am in the final stages of master I am unable to work full time and the hours I do receive are very sporadic.

So the plan is to apply for spousal visa using 62,500 in saving which my wife has received from her parents. My question is will it be ok to apply when the savings are in the applicants (wife) name and not the sponsor (mine) and does it have be in British bank or will a Chinese bank suffice.

Additionally as mentioned above I am studying masters and in the middle of my dissertation which has limited my ability to work if I was to apply for universal credit over next two months (October and November), would this impact the application in March?

Only stipulation is that the money must have been freely accessible for the last six months by the applicant.

So basically so long as it's been on a bank account in her name for the six months and is not time/withdrawal bound it's fine.....

You need to show UKVI you held that savings for 6 months. You won't get Universal Credit as you and your wife have savings of £62,500. Universal Credit is an income based benefit and if you have more than 16K savings as you have for your wife's spouse visa, you can't claim it.

Hi thanks for clearing that up for me,I suspected I couldn't yet was told by citizen advice that since we weren't living together they weren't sure if the saving applied, although I was pretty sure they would.
