Applying for free education entitlement under Tier 2

Myself and my family are currently in UK under tier 2. Our son goes to a nursery, and as he is 4 the nursery manager says he is entitled to 15 hours of government funded education and is ready to apply for it. My concern is - could this be interpreted by migration authorities as violation of "no public funds" rule.

Discussion in some older topics here on forum suggests that education entitlement for children does not fall under the definition of public funds. What is the current situation ?

More importantly what is the actual practice of home office ? Has anyone here encountered/heard of a case when this was actually identified as violation ?

Would appreciate your input.
