CLAIMING BENEFITS, please advise

currently my two sons and wife are on FLR(M) visa, while other 02 childs are British, if someone can advise about following;

1. can i claim child benefit for all 04 children's, even though two of them are still on dependant visa? ( would they not accessing public fund if i apply)?

2. can i claim child tax credit for all 04 children's, even though two of them are still on dependant visa? ( would they not accessing public fund if i apply)?

3. if i claim housing benefit would it effect my Citizenship application( i am currently on ILR)? or my wife and first 02 childs further extension and ILR application?

4. I want to claim housing benefit only for my self and my 02 british born childs, and would have extra room and pay by my self for my wife and 02 son, then would it still cause problem in my wife and first 02 childs further extention and ILR application?

Your kind advice would be highly appreacited.

1. Yes you can. YOU claim, NOT the children. Child benefit must be claimed in YOUR name only.

2. Yes you can. YOU claim NOT the children. Child tax credits MUST be claimed in JOINT names with your spouse.

3. No and No. You can only claim a single person element with children. Your wife won't be counted.

4. Housing benefit will be calculated based on your earnings and yourself/children.

Remember that you need to meet the financial requirement AGAIN when they extend their FLR(M) visas or apply for ILR.

I really appreciate your valuable advise, yes I do know that my family would need to fullfil financial requirement at extention and ILR and my earning is well above that requirement...


Can you please clear me one point, as you said housing benefit I need to claim as a single person element with children's, so would I claim with my all 04 children's including the 02 who are on still my dependant visa or only with my British passport holder child's? And if I claim with all 04 children's so would it not make any trouble in extention/ILR of my first 02 sons who are on dependant visa( no access to public fund).

If your income is 'well above' the financial requirement, it is unlikely you will qualify for much or any benefits.

You don't say if you are on ILR or if you are British.

Here is the link for the benefit calculator turn2us (click), if you complete it with your income and circumstances, it should give you an estimate on whether you qualify for anything. If you hold ILR, complete the calculator and select your status as British.

I have used this and other entitlted calculater and as per them i am entitled to claim and receive some money.....

But my question is still there That should i apply housing benefit for my all 04 childres or for only 02 who have British passport?
