Tier 2 (ICT) dependants

Post by shaileshmukun3 » Sun Jan 10, 2016 5:07 pm

Hi,
I am on Tier 2 ICT and will be filing for ILR in this month. My current ICT visa is valid till 2017.
My First Question

1. After me switching on ILR - Can my spouse (living in UK since last 5 years and eligibly for ILR) continue on the current Tier 2 Dependent Visa valid till 2017 Or is it mandatory for her as well to immediately convert to ILR within a specific period? I want to file her ILR in 2016 if permitted.

2. My child is UK born. I have heard he can apply for British citizenship immediately after I get my ILR. May I know what documents/forms are needed to proceed in this matter?

Many thanks in advance.

Regards,
Shailesh

1. Are you applying for ILR based on Tier 2 ICT which you have held since before April 2010? If yes, she can apply with you for ILR or she can wait and her current visa will be valid. If you are applying on the basis of long residence, she doesn't qualify for ILR with you.

2. Correct yes, see FAQs Citizenship (click)
