Dependent of 10 years student

Post by rehmat351 » Fri Mar 25, 2016 4:03 am

Since Sep 2006 I am in the UK on different visa categories (student + PSW + Tier 4 + Tier 2 + Tier 4). In July 2015 as dependent of Tier 4 (G) student my wife arrived in the UK. I am planing to apply ILR on the basis of 10 years. How I will extend her visa. We both apply for IRL on the same day?

No, she doesn't qualify for ILR.

She has to apply on form FLR(M) once you get ILR and meet ALL the requirements.

I agree , wife will have to switch to FLR (M) after you acquire ILR, subject of course to you meeting the financial requirement.

I agree with CR001 too.

Dear All
Thank you very much for the replies. Please note my wife is my dependent (Tier 4 (G)), she is full time MSc student in UK university. I am PhD student. We both are not working at all. In this situation is it mandatory that I must be getting £18600?

My current Tier 4 (G) visa will expire on July 2017. I arrived in the UK in Sep 2006, hence in Sep 2016 once I got ILR then what would be the time frame that she must apply as ILR dependent? Home office will issue her 60 days letter or not?

Thanks in advance.

Rephrased the above post, please ignore that.

Thank you very much for the replies. I am PhD student. My wife is my dependent (Tier 4 (G)), she is full time MSc student in UK university. We both are not working at all. My current Tier 4 (G) visa will expire on July 2017.
Please answer my question below,
(i) I arrived in the UK in Sep 2006, hence in Sep 2016 once I got ILR then what would be the time frame that she must apply as ILR dependent?
(ii) We both are not working and in this situation is it mandatory that I must be getting £18600 to sponsor her to become as ILR (my) dependent?
(iii) Home office will issue her 60 days letter or not?
(iv) Recent changes (18 March 2016) effected in any way to the ILR route of 10 years long lawful residence in the UK.

Thanks in advance.

(i) Before her leave expires or, if travelling, before she enters the UK.

(ii) Yes.

(iii) Uncertain.

(iv) Are you referring to the English language changes?

Thank you very much for reply. Vinny (for your question/answer iv), I think she would be OK for English requirement because she is doing her full time MSc in the UK university. Is there any other requirement which effect my case (10 years long residence), please see my previous posts.

Question 1
Would it be possible after getting ILR instead of getting a job of £18600 I would become self employed and start a service business, for example, home repairer, taxi or London mini cab driver etc.. In this case am I fulfilling the £18600 bottom line?

Question 2
When my wife will apply FLR(M), lets say within two months of getting me ILR then how I will prove that I will make (next 12 months) £18600 because I am doing self-employed business, and there is no wage slip?

Question: Regarding English requirement she will apply FLR(M) in September 2016 and MSc degree will be in her hand somewhere in November/December. So lets forget MSc degree. So to apply FLR (M) in Sep 2016 can she use her IELTS with 6.5 (expired February 2016). Would it be sufficient or she need to do any other test?

Question 1

Question: I will need to do all this in advance, I mean first ILR then self-employed. After becoming self-employed in first one or two months I will do self assessment SA302? Then submit that with her FLR (M)?

No, self assessment is done once a year as far as I understand at the end of the tax year.

CR001, we really appreciate your prompt reply.
Her IELTS test center was in London (London Crest Open Center, Premier House 7th Floor, Station Road, Edgwer Road, Edgwer HA8 7BJ, UK). This is OK or not.

Thanks
