Hiya,
i came as a Student in 2005 and from 2005 to 2014 i lived legally with extension on Student Visa before my last extension finished i applied for Human Right as i have wife and 3 kids which are born in UK And wife on Student Dependent Visa My case was refused and i challenged in Court Appeal Won From First Tier Tribunal because i have 10 years legally at that time Home Office Challenged my Appeal to Upper Tribunal base was that Judge gave a decision on oral evidence where i have 10 years No Passport was available Home Office said to Judge we have to check its passport that he is been out from the UK for 18 months in total 10 years or 1 single absent for 6 months.
Upper Tribunal appeal was remit to first Tier Tribunal Judge said to Home Office Bring passport to check exit and entry dates in mean time i have withdrawn my case from tribunal because i knew i never been out from the UK for more then 5 months and one single go for 2 months.
My appeal withdrawn from court i booked appointment for Croydon Peo for 2nd week of May now the issue is Home office is holding my passports and my passport is also expired What are the chances.
Any can help how to get back my passports to Croydon PEO where my appointment is been booked i wrote a letter to Durham Home Office where i initially applied for Visa way back in 2014 thought passport will be with them but they have not replied yet time is near and what about Expire passport will home office will accept my fresh SET LR Application on 10 years Base where i have now more then 11 years legally living in UK With 6 months outside in total and 1 go 2 months so legally i am fine i have ILETS and Life in the UK as well.
Please help me Thanks any seniors are welcome

The reason i have withdrawn my appeal because it was revert to First Tier Tribunal for a fresh hearing as UT Judge ordered the HO to bring passport and the case was for 2 years extension with the family and if i get decision in my favor i have to apply for SET LR so i thought rather then waiting for so long lets apply SET LR as i was frustrated because HO was not bringing passport to court and they have accepted in court that i am here living legally fore more then 10 years but we have to check applicant entry and exit dates for how long he is been out from the country. where my wife and kids still in the court waiting for there hearing date its just me who withdrawn my appeal as i am living in UK for more then 11 years

You should have had it dealt with at the Tribunal.
You should be able to use PEO.
You could get it even if Passport is expired.

If Expired Passport Which is With the Home Office it Will be Great Brov Coz i am a bit confuse i have searched everywhere but could not find a clue about it as i thought it was a Fresh application they might say its invalid Coz Your passport is expired But anyway thanks i have PEO appoinment Reshedule on 12th May 2016 let see What happens there and Yes Some Solicitors Say You should Wait in Tribunal Coz the decision was in ur favour but any how thanks

Got a Call From HO in the Morning The HO Guy told me we have made Decisiom on Your application You Can Collect it tomorrow They have my Passport as Well let see What Will be the Outcome Thanks Guys and Also if any one Tell me After how many Years of SET LR i Can apply for British Passport as i know that I CanApply for passport for my kids straightaway Thanks

You have to wait a full 12 months on ILR before you can apply for citizenship assuming you meet all the standard and good character requirements. If you are married to a British person, you don't have to wait 12 months.

Thanks and in that 12 Months I Can Visit Outside UK Or if i Go Outside UK for Holidays Say like for a Month Then should i have to Wait for 13 months to apply for British Passport ?

You are allowed up to 90 days absence in the 12 months.
apply for British Passport
Only British Citizens can apply for a British Passport. You have to apply to naturalise as a British Citizen (current cost £1236). A passport application is a separate process after you are approved for citizenship and have attended your ceremony.

PEO Appoinment Booked For 10th May 2016
Outcome Was Letter Handed For Further Checks as my passport Was not Submitted With My Appliccation for SET LR as i Withdraw My Case From Tribunal So Passport Was With the HO but With Other Department.
Call Revieved on 17th May 2016 That Decision is been Made
Collected My Documents On 18th May 2016 With ILR Approve

If i have ILR Can i Apply Benefits For My Child Where My Two Childs Appeal is pending in Court While 2 Other Child Born After Initail Case FLR FP IN 2014 I have No Passport For Them two So Can i Apply For Child Benefit Where Childrens have No Status But Will Sumit MN1 Form Soon For All Coz For That I have to Withdraw appeal For my Two Childs and the Other problem is passport is With the HO Can i apply MN1 without children Passport All 4 Born in UK.
Will Appreciate Any Moderator Reply Thanks

Thank you ..that means I have to withdraw appeal once I pass 10 year.ana I will get conformation latter within week ..after that I have to book peo...without conformation latter I can not go peo...m I right?
And also can I tell me how u withdraw appeal by fax or post...any special word we have to use when we withdraw appeal..do u think I have higher Soli for withdraw appeal

I Namewant to withdraw my appeal, for reference my appeal number is quoted above. My instructions is that i will submit a fresh application to the Home Office on the basis of long residence (10 years) within the next 28 days.
As my appeal was heard on 31st March in Upper Tribunal and the Judge Remit my Case to First Tribunal for the Fresh Hearing Where my Finding is that i have never been out from the UK for more then 8 months in Total 10 Years and in One Go i left UK for just 1 and Half Month Where Homeoffice is not presenting My Passport infront of Judge i have a Very Strong Case on Years Rule as i have Life in the UK and Englist Language Test ( ILETS) available.
If you have any questions in respect of the above Kindly Contact me.

Thank you very much for giving me format...I have all my document with me including passport..that mean I can withdraw appeal by email too..not necessary by fax or post..I was thinking by fax...thanks again..I don't things so I have to higher soli for that as per ur experience..
