ILR Tier2 General not earning £35k

hello i have few question to ask please help me
1) currently i am on tier2 general visa as a restaurant manager ,i got this on 27 jan 2012 ,i know i have to earn 35k for eligible for ILR but my employer is not ready to give me 35k ,can i transfer my work permit if new employer is ready to sponsor me ,also how many months bank statement i will be need to apply ILR
2) also i came in uk august 2007 on TWST VISA and left uk in july 2008 and came back again on student visa oct 2008 ,so will it be count as 10 years for ILR

1. You cannot 'transfer' your current visa to a new sponsor. You need to find a new sponsor, RLMT needs to be done, CoS issued and then you have to apply for a new Tier 2 General.

HI ITS called training work permit which i did in 2007 to 2008 in hotel after finishing my course in india
