Continuity Period

Post by Smeera » Wed Jun 22, 2016 1:04 pm

Hi, I have a quick query around my ILR application, I am a Tier-2 General dependent on my husband who is eligible for ILR in July 2016.

I got my Tier-2 General dependent visa stamped on 27-March-2012 in India.
I first arrived in UK on 24-April-2012, since then I am in UK only with following trips showing outside days

No From To no.of days outside UK
1 29-Sep-12 07-Oct-12 8
2 03-Mar-13 22-Apr-13 50
3 20-Mar-14 06-Oct-14 200 - Pregnancy
4 08-July-15 02-Jan-16 178

I have got Tier-2 General dependent visa extension in Oct-2013
then my husband changed his sponsor so I got issued 'change of sponsor' (new BRP only) in Feb-2015
again he changed the sponsor and I got issued new 'change of sponsor' (new BRP only) in May 2015

Overall, my Tier-2 General dependent visa has been stamped only once on the passport (March 2012), later whenver we extended or changed the sponsors, I got new BRPs.

When I read the UKVI rules, it states that if you are a dependent and your visa has been stamped before 9-July-2012 then you just need to complete 2 years of continuious stay.

with above data, do you think I can also apply with my husband (next month)?

OR I have broken the 5 years continuity clause (as I was away for 200 days for my pregnancy)

OR though I have broken the clause of continuity (more than 180 days), I am still completing my two years on 06-Oct-2016, I can apply on 07-Oct-2016?

any guidance in above query is much appreciated.

Thanks
Smeera
