FLR extension period for spouse, dependant of refugee leave

Post by srisin » Thu Jul 14, 2016 1:07 pm

Hi !

My sister is married and her spouse is on refugee visa which is due for renewal in February 2017. My sister was already in the UK when she got married and was given first FLR extension up to August 2016 for 2.5 years. So now she has to renew her visa and due to apply within days. My question is would she get an extension for another 2.5 years or only up to her spouse's valid visa period( feb 2017)? If it's only up to spouse's valid visa period she has to pay for extension twice in 6 months interval :(

Thanks!

My sister has been given only 7 month visa and now she has to reapply again in February. One of my friend applied in exactly similar situation 2 months ago and his wife was granted 2.5 years. What can we do now ? Any possibility to re appeal ? They also going to refund 300£ Immigration Health Surcharge out of 500 she paid which was default.

A dependant's leave is normally extended in line with the main applicant, when the latter has limited leave.

It may be odd if a dependant's leave was extended beyond the period of leave that is held by the main applicant.

An exception is when the dependant satisfies Long Residence.

Thanks Vinny! Let me double check with my friend about his case.
In the meantime on next renewal how could they both apply over the post ? Is there a common form for FLR extension and main applicant ILR ? If not how could they submit the documents( passport,BRP) which are required in both applications ? Also how could home office make a decision for FLR while the main applicant applied for ILR at the same time ?
