Dear Senior Members and Respected Gurus,
Apologies for re posting the query.
I have previously posted below mentioned query in regard to my wife's and children's ILR eligibility but did not had any luck in getting response from senior members or respected gurus. Now the situation is that my wife's and my children's current tier 1 general dependent visa expiry date is approaching fast (current leave/EC expiring on 11/03/2017) and I need to book an appointment for premium (same day) services for my wife ILR application (if she is eligible) and then depending on the outcome I need to decide whether to post ILR or Tier 1 General dependent application for my children.
I was wondering if senior members could shed some light on below mentioned query. My wife has recently cleared her life in the UK test and received her Academic Qualification Statement and English Language Proficiency Statement - CEFR level C1 from UK NARIC.
I have received my ILR in November 2015 and have 0recently applied for naturalisation.
My wife joined me on Tier 1 General Dependent Visa on 6 May 2012.
Details of her residency periods in UK and India are as below:
6 May 2012 to 18 March 2013 - 10 months - UK
19 March 2013 to 25 September 2014 - 18 months - India
(as she was expecting our first child, who was born in India on 10/10/2013)
26 September 2014 to 9 August 2015 - 11 months - UK
10 August 2015 to 17 May 2016 - 9 months - India
(as she was expecting our second child, who was born in India on 16/11/2015)
18 May 2016 till date - 10 months - UK
Is she eligible to apply for her ILR or shall we apply for Tier 1 general dependent extension for all three dependents.
