Good day GURUS in the house. Am new to this forum and will be so glad if the moderators can advice me on my issue.
I got my Tier 2(General) in country extension on 28th November 2013 along with my minor dependant till 28th October 2016.On 30th March 2014 I received a letter from Home Office that my leave(flr) was curtailed to 29th May 2014 due to the revocation of my sponsor licence. Luckily for me I was able to re-apply via PEO under a new sponsor ALONE(without including my minor dependant) before the end of my curtailment and it was successful giving me a new validity date till 27 July 2017.
Early last month I was able to apply for ILR through PEO and it was APPROVED.

Question:
1) Can I now apply for ILR for my minor PBS dependant(leave expire 28th October 2016) now having lived with me for more than 4 years in the UK as my dependant and her first out country entry clearance was applied before 8 July 2012? .
2) I hope having not applied with her when I got curtailment on 30th March 2014 will bring problems? At that time I called home office and was told that she is only tied to my leave and if I can make a successful flr with a new sponsor she will not be affected

3) Am applying by post for her. Do I need to send my original BRP and Passport along with the forms or the Photocopies?

Yes you can apply for child. You will need to submit evidence of your ILR. Bear in mind that postal application can take many months. You can apply in person if you wish.

Thanks CR001 for your advice . Please, based on my second question, I hope my daughter ilr will not be refused. Please advice.
secondly, do I need to put in my original BRP and Original passport when am posting her ilr application or do I need to make copies of it cos I might need to travel before her ilr comes out.

Thanks CR001 so sorry for asking the question again and again i just want to be sure that the previous curtailment will not affect my daughter ilr application.
Also what type of form will I use for my pbs dependent child having got my ilr through tier 2 (General) IS IT SET (O) Form OR SET (F) Form???

Has my pbs dependent leave (flr) reinstated immediately I applied for the new leave (flr) with the new sponsor before the end of my curtailment.

The Home Office would normally issue curtailment notices to the dependants of the main applicant at the same time.  It is therefore strange that you received one, but your dependants did not.
 
The Home Office would normally expect you to apply for your dependant to remain in line with your current visa, so we think your safest course of action is to apply for them to remain as dependants in line with your old visa, and apply for ILR for her afterwards.
 


I believe that this forum is to give advice to members in times like this but I just don't know what I have done that makes moderators responding to my enquiry. Anyway this ehat I got from my solicitor and please can moderators please advise based on my enquiry

Members and moderators will respond if and when they wish to only if they know the answer. We also offer our time for free in between our job and family commitments. I don't know.

We can't possibly know the full circumstances and your solicitor should be more familiar with your case and probably best to advise you.
