Need a help on my family visa extension refusal

Post by akm_nather » Thu Sep 08, 2016 4:30 pm

My name is xxxxxxx xxxxxx . I managed to get my family through settlement visa. My first family's arrival to this country was on 24th of December, 2013. The embassy gave my family the visa on the 16th of October 2013. My problem currently is, my wife and my son's visa had ran out on the 16th of July, 2016. So to the renewal of the current visa to a new visa, I have sent an application to the Home office on 10th of June, 2016. But due to the fact that the application have changed, I have to send a new application to the home office. On my previous application, they have asked my evidence of the employment and the evidence to show the annual income of my father which we sent with the previous application. As the new application came to use and the time limit of submitting the original documents, it was short because we have already sent our documents in previous application. So on the 6th of September, 2016 I have received the decision from the Secretary of the state which is the application to leave to remain in the UK has been refused due to the fact that my father's low income. The low income caused due to the fact that the home office didn't take my temporary work payslips into account. In that letter it stated in 14 days from the decision, my father have to appeal a first tier tribunal in the court. So I would like some advice whether to appeal it or not. This is because I'm not sure what to do now. I'm not sure whether the appeal will be successful. Please leave a comment if anyone can help.

I'm confused. You mention your wife and son's visa but your father appears to be the sponsor as you seem to be relying on his income. :?

What visa did your family apply for to enable them to enter the UK?
(Casa, not CR001)

How old are you?

What do you mean by 'temporary work payslips'?

Only your father or mothers income will be taken into consideration for FLR(M) visa extension, not 'children's'.

My father wrote this which has mistakes, sorry. He worked some temporary work which he earned more and got all the payslips for it.
Basically he applied for the settlement spouse visa for me and my mother. We came here on 24/12/13. Mine and my mom's visa expired on 16/07/16. To renew it, my father applied the leave to remain application which the HOME office said it is invalid. In the old application, it stated to show the annual income of my father which we sent with that. Then it became invalid because the new FLR application have launched that very day when we applied. So we applied the new application which they also wanted annual income. We stated in that application that we already submitted the payslips. They wanted it again which my father tried hard to submit it. In a rush he placed various payslips and didn't really notice. The decision have arrived on 6th of this month which said the application has been refused due to the fact of low income. They didn't take my father's temporary work payslips into account in which he earned the most of his salary. They said that we have to appeal in 14 days to the first tier tribunal. So my problem is whether if I appeal, will my appeal will success?. If anyone have ideas please help me and let me know.
Very sorry for the inconvenience caused by my father's review.

Difficult to advise you. Not sure what your father's earning was. Whether you qualify under Category A or B, whether you supplied the right evidence or not.

Is your mum working aswell.

My father earned 27,000 and showed all the evidence in the first application. Due to the fact that it is invalid, they wanted it again which was hard for us to get. So on the new application, we sent the payslips which we can get at that time due.to the short amount of time and sent it to them. They said the income should be above 22, 400 which we had but I don't know why they haven't taken the temporary and agency work payslips into account.
