Main applicant now on ILR, before WP, dependants on WP

Post by mohibbi » Mon Sep 12, 2016 10:51 am

Hi.
sorry for my ignorance, posting one question, thanks.
I am on ILR, was on work permit before this, have got dependents, their visa still valid, can they travel without me, are their dependant visas still valid till next year or do they seize as I am not on ILR??

Many thanks

When you say 'work permit', what exactly do you mean? Tier 1 G, Tier 2 G, etc.

On what basis did you apply for ILR, 5 years PBS route or 10 years Long Residence Route?

Your wife should switch to FLR(M) before travelling (whether with you or without you). It is risky and there have been reports of members/dependents being refused entry.

Sorry
My wife will complete 10 years in Feb 2017, child same but is there any way to apply for child Naturalisation before the 10 year period

Instead of applying for FLR(M) now and then applying on long route basis would be unwise, wife's mom not well hence was looking for more options

Hi Mohibbi, here's my take. But still sample other opinions.
AS ur wife is completing 10 years in Feb 2017, it is clearly worth waiting it out. CR001 is correct about entry refusals for non FLR(M) 'dependants'. Feb is around the corner. Re child naturalisation, I would think you can immediately proceed with registration/naturalisation process as you are now settled.
Opinion is researchedly mine!

Children born abroad require ILR before they can apply for citizenship.

Many thanks.
That 7 year rule doesn't apply here, child spending 7 years in the country?, is the long residence the only option?

7 year rule DOES NOT mean 'after 7 years child can apply for citizenship'.

Child needs ILR before they can apply for citizenship.

It would have been far easier if you had applied for ILR based on PBS 5 years residence as they would have been able to apply with you.

Sure, this is all very helpful.

Lastly, in my situation now, its my wife and one child, who have lived in the UK since Feb 2007, are on dependant visas till April 2017, there only option is to wait till Feb and then apply on the basis of long residence route, no other quicker way ?

Thanks.

Yes, wait till Feb when they qualify (with no traveling out of UK) and apply Set(LR). There is no 'quicker way' unfortunately.
