What if your sponsor dies before your application decided

Post by hanging sward » Fri Jul 29, 2016 12:37 am

Hi hope everything going well for you all n in your favour.
I have a critical question if you got married with a British person and put up your application as spouse visa (FLRM ) what if your spouse passes away(dies) before application decided
what will happen?
What options could be used ?
What would be the status of the applicant?
I need your immediate response please any help will be highly appreciated .
Regards

Thanks vinny,
Is it necessary to have a valid visa at the time of partner death or even if your application is in process and visa is not granted yet.
For both is it same or different?

E-BPILR.1.2. wrote:The applicant’s last grant of limited leave must have been as-

(a) a partner (other than a fiancé(e) or proposed civil partner) of a British Citizen or a person settled in the UK; or
(b) a bereaved partner.

I'm so sorry for your loss, this must be a very difficult time for you.

Your current leave is still valid.

You will be able to apply for ILR as a bereaved spouse on form SET(O).

https://www.gov.uk/visas-partner-dies

"will be eligible to make a further charged application for indefinite leave to
remain at any time within the 30-month period if they are then able to meet paragraph SILR.1.5.
or S-ILR.1.6. Otherwise, they should make their next application no more than 28 days
before their extant leave is due to expire, or within 28 days of completing the period of leave
required for them to be eligible to apply for indefinite leave to remain."
