PBS dependent to ILR

Post by Dhi123 » Thu Nov 17, 2016 10:32 am

Dear all,

Could you please advise, after main applicant switches of ILR on the basis of 10 years long residence in UK, if his PBS Dependent PBS has been here in UK from October 2010 to till now. I am going to apply for ILR in Jan 2017. She was here as a dependent of Tier 4 & 2 years as PSW dependent and from April 2014 to till now as a Tier 2 (General) dependent. Her visa is expiring in March 2017. Please advice me how she can have the ILR status? Also please let me know the next step for her. I have a 4 years child she born in UK. When I become ILR I can apply for BC for my daughter. But for my wife I am confused.

Your reply much appreciated.

If you apply for ILR based on long residence, she will not qualify for ILR and has no option but to switch to FLR(M) and meet all the requirements. This will be a new 5 year route to ILR (2 x 2.5 year visas) before qualifying for ILR or 10 years ILR if she reaches that sooner and qualifies for it.
