Urgent pleas help !! Tier 2 to flro to tier 4 to tier 2???

Hi,

My employer decided not to renew my tier 2 visa nearly end of my 3 year contract (3days before visa renewal date) that they aren't going to renew my visa, even after giving me hopes that they will renew until the last minute. So only had 3 working days to leave the country. I have been living in the UK continuously for 7years, out of which 4 years for my undergraduate studies and 3years for work. So I literally can't imagine myself wrapping everything up my 7 year life in 3 days and go back home. So on advice of a local solicitor I have applied for flro on the day my visa expired, which he said we can buy in some time and will keep me with existing visa status that will help to apply for ILR. Now, I found a job in a company and they are in the process of applying for visa sponsorship licence, which they think will take until end of Jan 2017. But, I received a letter from home office for flro biometric, which I will have to give before end of 14/12/16. Meanwhile, i have already applied for Masters admission to study part time and asked them to convert my application to full time on the idea that I can switchto tier 4 student visa from flip and then switch to tier 2 general visa once my company gets sponsorship licence. I thought of this because I was told by local solicitor that my flro will get rejected just after biometric. My question is would there be any problem to switch from flro to tier 4 and tier 2 ?

Also, how can I cancel my existing flro and submit my tier 4 application, when the original passport is with the flro team?

I also tried filling the tier 4 student visa online application form, it hasn't got previous status as flro; should I say previous leave as tier 2 and what should be expiry date ???

Unlikely you will be issued a CaS to apply for Tier 4 with a pending FLR(O) application.

Yes, RLMT will be required in this very complicated situation the OP finds himself in.

Tier 4 sounds unlikely.

Tier 2 should not be taken for granted.
if potential sponsor is not yet licensed then clearly you have been pre-selected for some role. And that sponsorship license shouldn't be taken for granted either.

I believe the University is ready to issue the CAS for my visa and I will be withdrawing my FLR(O) application on the day of Tier 4 application.

My company has already done the RMLT, they genuinely couldn't find anyone, hence they have applied for Sponsorship Licence and they will be recruiting once they get the licence.

Also, I am planning to withdraw FLRO my application, even before biometric. I will be doing my Masters in Full-time under tier 4 anyway (as I wanted to do masters). If my company can get me tier 2 visa, I shall continue my masters in part time, if not I shall complete my degree full time and apply again as Tier 2 General.

Are your University aware of your FLR(O) situation, and have they advised you to return home to apply from overseas? You are staring an obvious Visa Refusal in the face if you apply in the UK.

The University is well aware about my FLR(O). I kindly request the members to show me way around my problem without leaving the UK and not affecting my 7 years of time spent towards 10 year ILR. I have already gone through so much of hard time.
