ILE expiry (?)

My partner is Filipina, with British passport for last 15 years. (I am British). 3 years ago we applied for her son to join us here with the intention of settling and he was granted ILE on his Filipino passport. He entered full time education and is now in further education. His passport expired 25 Dec '16 and we have now had an email from UKBA telling us that he should have left. Surely if he has ILE he can stay and only needs a passport if he needs to travel? The UKBA website even says there is no need to transfer the ILE to a new passport. Can anybody tell me what we should do please? :?

Double-check his passport to verify that (a) he was issued with an ILE and (b) that he was never subsequently stamped in at the airport with a time-limited visa, such as a visitor.

Has he ever spent a significant period of time (more than a year and half) outside the UK?

Best not to refer to the UKBA website as the UKBA were disbanded in 2013 due to being unfit for purpose. For up-to-date information, refer to the UKVI.

However, you are correct. ILE is permanent residence issued outside of the UK and the equivalent to ILR issued within the UK.

I'll check that. He's been back to the Philippines for 3 weeks since he's been here
