Moving to a new flat during BC application

Post by Angie77 » Sun Feb 26, 2017 11:39 am

I was caught by surprise by my landlord last week saying we have to move to another flat as he will have to sell this flat we currently being living in.
I Have applied for BC on 22 dec and I hope if decision has not already being made it will be made soon.
I was thinking to use the services of mail redirection that royal mail offer instead of changing my address on the Home Office, in case my approval letter is on the way and also to get my passport afterwards.
I am just concerned that due to the tight time frame to book ceremony, by using the service of redirection the letter may arrive at my hands too late, when time has already lapsed. I am also concerned if I decide to change my address within Home Office only, they may send by mistake my letter to my old address as this the one that is on the application form.
What should I do?

Your landlord cannot just end the tenancy and tell you to move because of xyz reason. There is a process he must follow as laid out in the Housing Act.

He must serve a Section 21 notice give you at least 2 months notice. Even this does not end the tenancy, only a court order can. This whole process can take up to 6 months.

Hopefully your deposit is protected and relevant information regarding scheme given to you etc

Edit : moving to another flat with the same landlord is a completely new tenancy.

Thank for your quickly reply.
In fact the landlord only asked us to relocate to another of his flats in the same city but different address. We accepted because it is a bigger and better flat and the rent will be the same. Both parts agreed. He will still let me keep the keys copy to check for letters until he sells the flat.I am just worried in the event he sells the flat very quickly and I have to hand the keys over, also I know it may sound silly but just do not feel comfortable knowing that other people could have access to this important letter and even throw it away. Just wonder what would be the best move in this case. What do you think?

A property purchase takes 3-5 months to complete before you will have to hand over keys.

Good to know. So I think the less risky route is to leave as it is and keep checking for letters everyday.
Hopefully I receive the letter this week before moving and I can take this weight off my shoulders.
Thank you so much for your response
