Help needed with FLR (M) application asap!

Hello everyone,

I’m currently in UK on Tier 1 Entrepreneur DEPENDANT visa which is due to expire on 8th April 2017. So when I came to this country in 2014, my husband was on Tier 1 Entrepreneur visa but last year in February, he got his Indefinite Leave to Remain (ILR) on the basis of 10 continuous years.

So that’s my present situation briefly explained. Now I need to apply for a visa and I understand that I can’t apply for ILR yet as I haven’t been in the country for 5 yrs.

1. So the 1st question which arises is which visa do I apply for? Is it FLR (M)?

2. Secondly, if it’s FLR (M), then how do I prove my English language eligibility? I have a Bachelor degree in Journalism which I completed in India. So would submitting this degree alone considered valid enough to prove my English language ability? Or do I have to obtain a certificate from NARIC to prove this?

3. Thirdly, do I have to pay Health surcharge?

4. Lastly and most importantly, we are showing my husband’s employment income as financial requirement since I’m not working. However, my husband is employed only from past 5 months as a permanent employee at a contract of £24000 p.a.. So now the question is how can we show payslips of last 6 months when he is in job from only past 5 months? Or can we use cash saving to meet this requirement as my husband has around £35000 in cash savings which he has held for more than 6 months.

Yes, FLR(M). This will reset your clock to zero and you will need 5 years (2 x 2.5 year visas) on FLR(M) before you qualify for ILR.

You need NARIC ELA for a foreign degree or the English A2 test.
3. Thirdly, do I have to pay Health surcharge?
Yes, £500 for the first 2.5 year visa and whatever it is at the time you apply for an extension later on.

The requirement is to show 6 months payslips and bank statements. You can use cash savings, the first £16,000 will not be considered though. When does your current visa expire?

Many thanks for your valuable response. My current visa expires on 8th April 2017.

1. Regarding my 2nd question of English language requirement, do I need to obtain English Language Assessment or Statement of Comparability or both?

2. Regarding my 4th question of financial requirement, as I mentioned my husband has just last 5 month payslips. Out of which the November payslip has the amount of £1180 whereas the December-March payslip has £2000. So if I submit the November payslip, will they consider the lowest amount?

And lets suppose if I don't submit November payslip, so December-March payslip gives the total of £8000. So to my understanding, the cash savings which I need to show is £42500. Calculating as:
42500-16000=26500
26500/2.5 yrs= 10600
10600 + 8000(last 4 month payslip)= 18600

Is my understanding of this calculation right? Please clarify.

1. You need UKVI NARIC ELA - the red route.

2. The lowest figure payslip will be used to calculate income. What was your partner doing before November?

Thanks for your reply. Before November, my husband was unemployed for 3 months.

1. I registered in NARIC website through red route. So do I need to apply for just English Language Assessment or Visa and Nationality too?

2. So if lowest payslip is used to calculate income, then isn't it advisable that we don't show this November payslip at all which has lowest income. And we show only December-March payslips of £2000 each month. And rest we show cash savings of £42500 if the calculation I stated in my previous post was correct. Kindly clarify on this please.

3. Also, I'm expecting my first baby in May, so does this affect my application in anyway?

Thanks for clearing my confusion vinny regarding the visa category I should apply in.. Now that I'm back to Flr M, can someone please clarify regarding the financial requirement issue I'm facing. I'm struggling big time with this one.. please someone please help me..

I'm summarising my financial requirement issue again here:

My husband has payslips for last 4 months only from December- March (before which he was unemployed for nearly 4 months). So presently his December - March payslip show £2000 each month. So can we combine cash savings to meet this financial requirement. December-March payslip gives the total of £8000. So to my understanding, the cash savings which I need to show is £42500. Calculating as:

Hello everyone,

I'm about to apply online for my FLR M visa on 6 April. And I'm supposed to move into new rented home on 8 April. Now when I went to my estate agent today to verify documents, they said that my visa is expiring on the same date 8 April when I'm supposed to get the keys for the new home. So they said we won't be able to give you the keys unless you have at least a Home Office Reference Number. So my question is if I apply online on 6 april, will I be getting a home office reference number?

Please reply at the earliest.
