Tier 4 Entry Clearnce Visa Refused!

Hello

My Tier 4 visa for entry clearance is refused according to paragraph 245ZV(k). I achieved necessary 40 points.
Please advise me the necessary steps at this stages.

Did the Entry Clearance Officer give reasons as to why s/he was not satisfied that you are a genuine student?

Yes. I was in the UK for five years.

Firstly, Why I didn't submitted any qualification regarding my previous study.

I just only submitted those qualifications that I used for getting my CAS.

Secondly, Why I did not complete one of my previous course in 2011

I could not complete this course because it was wrong course for me as I realised after enrolling but I tried to complete this unfortunately I could not. It was only 9 months programme.

Please inform me, do I need to carry my maintenance during AR if I apply for it.

That's an odd thing to include under credibility, given that you have the 40 points for the CAS.

That seems a reasonable answer, but they appear to have not accepted it.

Before requesting an AR speak to your Tier 4 sponsor on Monday to check if there is still time to request the AR, get it processed, travel to the UK and enrol.

I received my refusal on 2 October and sent to my sponsors for reviwing. They suggested me for applying AR and let them know the outcome. But if AR will not be overturned what should be the remedy for this refusal? I achieved 40 points and didn't fall any other immigration rules but they refused just using the power of 245ZV(k) which was given last year.

If my AR is successful, does my tier 4 sponsor need to provide another CAS to support me for late entry as it is used already and my latest acceptance date is 10 October.

No, but 10 October is tomorrow, so unless they will extend the deadline you could not use the visa anyway.

Have you checked with your Tier 4 sponsor whether you can still join the course, given that the enrolment deadline was already over a week ago? It seems likely that you will need to defer your studies until the next enrolment, which might be a year from now. Assuming this is so, there is therefore no immediate deadline for the AR, but definitely still worth doing it.

I just received my AR decision which is eventually refused. The decision to refuse is maintained the same reason at review.

I already sent an email to defer my place for next enrolment. But the question is how can I resolve this matter in my next attempt while they overlooked everything. What will be the remedy to save myself from refusing.

I advise you discuss your plans with your Tier 4 sponsor. They are best placed to advise because they will need to be satisfied that your new application is not likely to be refused before they issue a new CAS.

Pingme can u tell us the refusal reason mentioned on your last refusal. eco would have mentioned the full reason for refusal. Many of us are returni g students and waiting for like 2 months nearly. It would help us.

Date u applied
Date visa refused
Did u got unfortunately case not straight forward
Did u got second interview call and after how long u got call.
Reason for refusal mentioned on refusal of exact would appreciate.

Mate 245ZV(k) would have given you a reason . They can only refuse you on that if you have 40 points that is why I am asking you what did it stated and the details as I am a returning student and waiting from 2 months. Would appreciate if you could tell the detail. Would help many returning students to clear our thoughts.No harm in that bro.
