Partner Visa form FLR(M)

Post by Ukkeegan » Tue Aug 22, 2017 8:12 am

Please can someone give me some advice, We applied for the partner visa at the weekend and we have our premium day appointment in 3 weeks, My husband who is Canadian had a civil partnership in Australia 4 years ago with someone else, When we completed the Visa online it asked for a copy of the termination of his civil partnership. But in Australia you don't have to end a civil partnership, In Australia a Civil Partnership ends automatically soon as either party either dies or remarrys. is this going to be a problem?? Thank you

In UK, a dissolution of Civil partnership is needed.

My partners Civil partnership was in Australia and a dissolution isn't needed in Australia, Just hope not having a dissolution will cause problems

I understand you can end it formally in Oz, and as that's what the UKVI wants, you'll need that proof.

In Australia, you only apply through Births, Deaths and Marriages when the relationship is over and you no longer want to have the civil union. However, if either party dies or remarries the certificate is already null and voided automatically and doesn't have to be registered with Queensland BDM. Would an email suffice to say that it has been recorded for the UK visa as there is no certificate because the marriage certificate has been provided to Queensland BDM instead?

I dunno for sure, just these things are tick boxes, no tick, no visa in my experience.

If you have stated in the form that your partner was in a previous civil partnership, HO will expect to see documentary evidence that your husband was free to marry you.

Likely an error. Email the address in the leaflet that you got and explain about the dates and see what they say.
