List of Documents for 2nd Tier-1 Entrepreneur Extension

Post by OhmV » Mon Sep 18, 2017 7:05 pm

Hi all
I am going to apply for 2nd Tier-1 Entrepreneur Extension as due to my absences from UK ,my eligibility for ILR is not due till May next year & my current leave expires we before, here is the list of documents I am submitting, kindly review & provide your valuable input as am little worried on couple of points.

# investment of £200K after initial entry: I am not submitting any evidence due to the fact that I had got extension in Dec 2015, so I believe don't have to provide any evidence, I will still provide last 12 months business bank account statement, VAT Return & Annual accounts for last 3 years.

# Companies appointment report & filing history from companies house showing registered office as well as name of Director

# Copy of latest annual return made up to 11/07/2015, confirming shareholding in PVT Ltd Company

# Copy of certificate of employer’s liability Insurance by Allianz in the name of company

# Current appointment report & filing history provided by companies house, showing appointment of me as a Director since incorporation , till date

# Copy of Passport which contains Visa which has been stamped on first entry into UK

# Copy of passport of 1 employee who is British & has been with the company over 2 years, now my confusion is since I got intial entry before 2014, will I be able to use transitional clause & show this full time employee who has been paid monthly salary.

# I do have couple of other British Passport holder employee, both with 18 hrs contract/week but they have worked on an average of 30hrs per week, only glitch is that passport of one of the employee expired in 2015 and she hasn't renewed it since then.

# Wage slips of all 3 employee covering last full period, P30, showing details like gross salary, tax, NI deductions, national insurance number as well as start date of full time employee

# Duly Signed Full payment submission (FPS)/RTI summary from payment gateway covering last 24 months

# English Language: Since I got last extension as Tier 1 Entrep, am claiming points on that basis

# Maintenance: I have been maintaining over £5K in my current account but made a stupid mistake of transferring 4.5K into savings account of same bank, what should I do in this case, is it OK to show both my current & savings account as else I would have to wait just 4 days before my current leave expires to fulfill 90days of consecutive balance requirement.

You do need to have the employee for 24 months after Dec 2015 (last grant)

# I do have couple of other British Passport holder employee, both with 18 hrs contract/week but they have worked on an average of 30hrs per week, only glitch is that passport of one of the employee expired in 2015 and she hasn't renewed it since then. - There is no requirement that the passport has to be still current

# Wage slips of all 3 employee covering last full period, P30, showing details like gross salary, tax, NI deductions, national insurance number as well as start date of full time employee

# Duly Signed Full payment submission (FPS)/RTI summary from payment gateway covering last 24 months

Thanks Marcnath

Using transitional clause for creation of jobs & showing 1 employees details for 24 month: I understand that it could be used but may not be useful in my case as I will have to wait till December to complete 24 months, same time when my extension leave finishes so it's better to provide additional evidence of other 2 employees.

Confirming the Shareholding in PVT Ltd Company: Whilst trying to print out annual return which is statement of confirmation now, I realized that it doesn't mention the shareholding anymore, in fact latest one says confirmation made with no update., where do I get a companies house document to provide evidence of latest shareholding.

Maintenance Funds: Just to doubly sure I transferred £4.5K from current account to savings which brought the balance down to £500 for current & savings which had nil balance shows that transfer, so combining them together doesn't breach 90 days limit but individually they both have, hope this will be fine

Many thanks

Sign into to Companies house webfiling service (https://ewf.companieshouse.gov.uk//seclogin?tc=1) and request company information by email.

Yes, you can combine maintenance funds across multiple accounts

Tier-1 Entrepreneur Extn FPS Clarification

Post by OhmV » Mon Oct 23, 2017 8:03 am

Hi all
I am just about to file my extension & need some clarification wrt full payment submission. My company has few employees who are on weekly & a couple on monthly payroll. When I log in to company's HMRC account, I can see monthly PAYE summary, which also has details of FPS breakdown, for the purpose of my application, have taken the printout of all 12 months and it appears like following:

PAYE statement (month 6)
Period: 6 Sep 2017 to 5 Oct 2017
Charges £528.19
See breakdown
Full Payment Submission (FPS)
Income Tax £170.60
National Insurance - employer's contributions £191.23
National Insurance - employees' deductions £166.26
£528.09
Construction Industry Scheme (CIS)
£0.00
Employer Payment Summary (EPS)
£0.00
Payments and credits £191.23
Total due by 22 October 2017 £336.96

Now every time my accountant submits the payroll information to HMRC, he receives an automated email confirmation which is very generic & goes like this

"On Friday, September 8, 2017 7:33 AM, "gateway.confirmation@gateway.gov.uk" <gateway.confirmation@gateway.gov.uk> wrote:

Thank you for sending your Full Payment Submission.
The submission for reference XXX/XXXXX was successfully received on 08-09-2017 and is being processed.

This is an automatically generated email. Please do not reply as the email address is not monitored for received mail".

Can someone please advise which one shall I provide as an evidence for FPS, am personally thinking of the screen shots from HMRC account for each month as email doesn't have much information except acknowledgement that your FPS is received.

Many thanks

I don't think either of them meet the requirement.
An FPS is a record of the submission and should show the employee's details and the amounts paid.
From the guidance document:
2) For reporting from 6 October 2013 onwards printouts of Real Time-Full Payment Submissions which confirm the report of PAYE income tax to HMRC.
187. This evidence in 1) or 2) above must show the total payments made to the settled workers as well as the tax deducted and date which they started work with the applicant’s business.

Thanks for your response Marcnath, I am also submitting weekly & monthly payroll summary which does have all these details, following is what it contains

# Name of the company with title of Wages Payment
# Date & week number for which payment is made or month number for monthly payments
# Employee Name & their Tax Code
# Number of hours worked, rate of pay, gross pay, PAYE,NI (employee & employer) & SSP deductions along with Net Pay for each employee
# Total PAYE & NI Liability to the company

This I receive on weekly basis from my accountant as soon as he files payroll, do you reckon this could be classed as FPS instead of weekly payroll summary.

Yes, those seem to have the information needed.

Normally, the FPS submission does clearly have a heading that says Full Payment Submission and has all of these details.

Since there are different payroll software and each has their own format, it is impossible to give a definite confirmation. Ask your accountant for the FPS submission and if this is what he/she says it is, then you need to just depend on that.
