Applying for ILR after tier2 - five year route

Hi,

I will be eligible to apply for five year route ILR on 20 Nov. 2018.This is after considering the 28 day period before completion of five years. However, my tier2 gen. Visa expires at the end of Oct. 2018.

Is there any provision where I can apply for ILR without having to extend my tier2 visa? Because otherwise, I'd have to spend money and time on two applications - one for tier2 extension and one for ILR.

Any help appreciated. Thanks.

If you have valid Tier 2 visa at the time of ILR you should be okay to apply for ILR.

Hi makky86,

I wouldn't have a valid tier 2 visa at the time since my tier2 visa expires approx. 20 days before I become eligible to apply for ILR.

You must have a valid visa at the time of applying for ILR. It does not state it must be valid upto the 5 year mark.

I started my employment on tier4 visa after completing my studies. The same employer sponsored tier2 visa after two months. Do those two months count towards five years required for ILR?

No they do not as Tier 4 does not count for ILR based on 5 years residence. You can only apply for ILR within 28 days before the date your first Tier 2 visa was granted/issued.
