Hi,

I have a quick question. I have been in UK legally from last 8 years and right now I have applied Extension for my tier 1 entrepreneur visa. I am planning to switching tier 2 sponsorship. My question do the company need to show Resident labour market test for me?. I am applying in category of FINANCE.

If the job is NOT on the shortage occupation list, then yes, the sponsor MUST complete the full and proper RLMT process before they can offer you the job and issue a CoS.

Just quick question what should be company first step. Shall they register themselves with HO and then conduct RLMT or they can do that simultaneously?

Another question once conducted RLMT how long is that valid for?

If the sponsor is not a licensed HO approved sponsor, they will need to apply for a sponsorship license.

RLMT is usually valid for 6 months.

I have two more questions

1. Is there any requirement that person in UK for 8 years must have certain amount of salary on TIER 2 sponsorship?

2. Another question varying application for Tier 2 Sponsorship is merely to expedite my case as on Tier 1 Ent extension HO is taking enormous amount of time. Is it possible once applied for variation through premium service for sponsorship category HO still take long time by unnecessary reviewing my Tier 1 time period? in that case purpose of variation for Tier 2 would be dead.

1. Minimum salary muat be £30,000pa but if the minimum salary foe your SOC is more then you have to get the salary stated in the SOC. It makes absolutely no difference how long you have been in the UK.

2. If you apply for tier 2, your tier 1 application will cease. However HO could take time to check you have met requirements for all visas held, usually at ILR point and i am assuming you are trying to get to 10 years long residence, which is not always the "safe" route.
