ILR from Tier 2 G route - Tax query

Post by mahe333 » Mon Jul 30, 2018 11:17 am

Hi All,

I am planning to apply for my ILR soon and have a query regarding outstanding tax.

The situation is as follows

1. Been working full time for the last 5 years on Tier 2 G visa.
2. Switched jobs in 2016 to a new sponsor.
3. Payroll provider made a mistake when filing P60 and resulted in tax underpay for year 2016-17.
4. HMRC sent P800 and now in the process of recollecting the tax due on a monthly basis.
5. Payroll provider sent and EYU(Earlier Year Update) to correct records on HMRC
6. Employer, Payroll provider and HMRC agreed that the issue happened due to a mistake by my payroll provider and I have paid taxes correctly. However the records on HMRC are not yet updated even after sending the EYU by the payroll provider.
7. This is my main and only one source of income.

So I am concerned whether this would have a negative impact on my application? I am happy to pay up whatever amount is due even though as per records I have paid all my taxes correctly and it is just that the numbers got messed up on HMRC and my payroll providers end. What are my options? How can I resolve this situation? Please advise.

So I am concerned whether this would have a negative impact on my application? No I don't think so. as long as this is your sole income and tax return by PAYE.

I am happy to pay up whatever amount is due even though as per records I have paid all my taxes correctly and it is just that the numbers got messed up on HMRC and my payroll providers end. What are my options? try to get the letter from HMRC and employer and explain this in the cover letter it will be fine. How can I resolve this situation? I think like what you have explained here is sufficient. Just need to be supported by the HMRC and employer. Please advise.
