FLR (m) or SET (m) ????????????

Post by malamal » Fri May 16, 2008 2:44 pm

HI all I wonder if anyone can help,

I am about to apply for ILR as my wife's settlement visa runs out in June, however she will not have completed 23 months in the UK by the time it runs out. She actually completes 23 months, 3 days after the visa runs out out!

1) Some people are telling me to go ahead with SET (M) while others say FLR , what should I do???

2) if I send all the documents with the FLR form will I then have to send them again with the SET (m) if I get an extension for 3 bloody days??

would be most grateful if anyone could answer these 2 questions for me.

regards

Can you post the actual dates for visa expiry and when 23 months residence completes? There may be a way around by applying via post and paying by cheque to buy you some time.

Visa expires June 11,
23 months = June 14

Will i have to send all docs again after sending them once with FLR (m) when I apply for SET (m)??

Ok I guess there can be a work around.

Apply by post for ILR using SET(M). Post your application on 10th of June a day or two early may be. ONLY post using special delivery. Keep hold of the special delivery receipt as this would be the proof that you applied before the end of current leave to remain. Now pay the ILR fees by a cheque. It takes around five working days for the cheque to clear. Now it will take a couple of days for your application to be opened and then for the payment cheque to clear. By the time your application reaches the case worker it will be within 23 - 24 months mark.

This will save you the hastle of applying an intermediate FLR.

Thanks yaar for your idea, sorry i took forever to reply, much appreciated.

I suppose in theory that would work but what if the bastards say that it is not ok and I have to do FLR? do i have to re do both FLR and SET (m).

Recently realised that in the new FLR forms you have to go to bloody Croydon to make the ID cards which they want to implement on us all but thought they will test on guinea pigs who have no choice. They are truly a pain.
