Best option to shorten the pathway for spouse to get settled status

Best option to shorten the pathway for spouse to get settled status

Hi,

I settled (ILR) through Long Residence whilst my spouse was my Tier 2 General dependent visa and she is still on this visa.
We have a child born in the UK when I was on my Tier 2 General Visa.

I understand that because of my settlement route, all the years my wife spent on the Tier 2 general dependent visa won't count towards the qualifying years needed for settlement.

I have done some research which shows my wife will need to switch to the Family Visa - Partnerhttps://www.gov.uk/uk-family-visa/partner-spouse route which is first granted for 2.5 years and then extended for a further 2.5.

I understand the Family Visa - Partner can be granted on different routes - 2 , 5 or 10 years which also determines the number of years the person needs to be eligible for settlement.

I need advice on the best way to shorten the pathway for her in achieving ILR
  • Are their other options that we can explore?

No.

There's no shorter route to ILR than the one she is currently following, unless of course she qualifies for 10 years long residence before the 5 year period is completed. You haven't said how long your wife has been resident in the UK.

No.

There's no shorter route to ILR than the one she is currently following, unless of course she qualifies for 10 years long residence before the 5 year period is completed. You haven't said how long your wife has been resident in the UK.

In which case, I would switch as soon as possible. It would be inadvisable to travel outside of the UK until she has been issued with FLR(M).
