Visiting visa for my mum - Reference: GWFxxxx

Post by Wande » Thu Oct 25, 2018 10:05 am

Hello,

After writing a six page letter to the home office and supplying several documents to prove her wealth and getting another silly excuse, I have cried and cried unable to eat since yesterday. Can somebody help me, I have seen UKVI and home office destroy the health of so many I am scared they are trying to do this to me and my family. We are citizens yet treated so horribly, please I need help. Their excuse is the most lame excuse I have ever seen considering I conduct financial crime investigations myself.

Please can someone help me, I have figured I might have to just leave this country as I can't keep doing this, she has come in multiple times before and never stayed but the past 4 applications they just keep calling us liars. How do you call someone you have never found a wrong with a liar this many times.

Please hel UKVI is destroying , I feel I might have to leave hubby here with one kid and leave with one kid if he insists on staying here. I have suffered depression and migration for years in this country and explained my health status, and my mum's depression at not having access to us, it made no difference to them still.

They had all proof f wealth for her business and acknowledged this but the so called MW who signed the letter decided to question origin of funds in personal account which is funded mainly by business account which she solely runs with confirmation provided by her bank. How on earth does one keep fighting such as unreasonable institution that employs low class heartless individuals that cannot investigate cases properly and have no feelings!!! PLEASE SOMEBODY HELP ME!!!!

If you can write the exact refusal letter here, taking out personal information, we can hopefully see their exact wordings for their decision

" The decision"

I have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraph(s) 4.2 of Appendix V immigration Rules for visitors because you are applying to enter the UK for 15 days to visit your daughter.

You state you are self- employed as a business woman primarily trading .... You state you earn 4,000,000 NGN per year (GBP 8,385.18).

In support of your application you have provided business registration documents, company Diamond bank statements and evidence of transactions. However, I am not satisfied that these documents alone evidence your income, as whilst they may demonstrate the business exists, there is no evidence detailing your personal income is at the level stated above or that the funds in this account are generated from this employment. From the information on your application form and the documents you have submitted, you have not shown that your employment and income is as stated. I am not satisfied that your economic status is as declared.

Given the above, I am not satisfied that your personal and financial circumstances are as stated y you. Therefore, I am not satisfied that you intend to leave the UK at the end of your visit and that you are genuinely seeking entry as a visitor. Your application is refused under paragraph V4.2 (a) (c) and (e) of the immigration rules"

Mr or Ms MW of UKVI made sure to finish with an insult that we are liars.
Thanks

The first page states,

" Dear Mrs ....
Your application for a visit visa to the UK has been refused

What this means for you
Any future UK visa application you will make will be considered on their individual merits, however, you are likely to be refused unless the circumstances of your application change. In relation to this decision, there is no right of appeal or right to administrative review.

MW
Sheffield

She declared a business worth over GBP 80,000 with bank statement showing she sometimes makes weekly sales of up to 2,000,000 NGN. The business account had over 5,000,000 NGN balance and personal account with over 1,000,000 NGN at the time of application which was all presented them. The invoices of sales were also presented for evidence of transactions as they confirmed. I put my mum through so much trouble, despite being in a cash intensive business I made sure she does most transactions by bank transfer no matter the cost in Nigeria. She did all I told her, she actually does not pay herself salary so we had to estimate the drawings she makes from her business as annual income. She has access to all funds in her business account as well with confirmation letter presented from Bank. All these were not enough! We only quoted GBP 1,000 as spending money and I provided my payslips to support as I am funding her feeding and we own a 4 bed house to cater for housing. All presented and it makes the pain worse after all the trouble I went through and out my mum through, the whole process cost her so much as she used 2 agents with the first one swindling her and I made her use priority service.

In addition to business she showed evidence of owning her home outright plus income of 500,000 NGN per annum from rent and she has no dependant.

I really feel your pain..my mother in law missed my wedding due to stupid UKVI rules.

I applied for her again and managed a 2 year visa with no solicitor help

Let's try to address the refusal, it's good they acknowledge the business but being very particular with proof.

"there is no evidence detailing your personal income is at the level stated above or that the funds in this account are generated from this employment. "

So what do you have in hand that will show what is in the bank account as a direct result of sales? Invoices? Any evidence to match sales and statement deposits? Even if she does lump sum deposits, explain this in a cover letter.

Showcase what she spends on household utilities, on her property, and perhaps some payments are cash only and do not have transaction details like that?

You should be able to get the visa. Explain it all down to the T.

If this doesn't work, lobby your MP

Thank you Bathanza. Your analysis makes sense and I'm glad you have a sense of the business and yes, I forgot to make sure the invoices showing transactions that we submitted matched and were highlighted on the business bank statement. I am having that checked now as some transactions are paid in cash as it's a fast moving business so if we provided those invoices they won't appear on the bank statement. I will make sure in future this is highlighted as well.

Luckily fate brought me in contact with a lady yesterday online while I was lost in my pain and she happened to be my local MP and has offered to help me. So I hope to contest their decision with her help as there is already evidence to prove her employment and wealth to show that she is comfortable in her country and can afford the travel expenses. Also they could have looked up the businesses crediting or debiting the account online to see they were business related. I consciously wrote in the application letter that we have nothing to hide and they can call me if they have any queries which they chose not to do.

It's a lot of work trying to get everything from a developing country to look like everything from a developed country, like having to live in a country where things don't work as they should is not stress enough for my uneducated mum.

Thanks a lot I'll note everything you have said and make sure we always cover these in any future application while I fight this for now.

The things we have to bear, I hope your spouse was still able to enjoy the big day without their mum.

Best Regards

That's great you can get your MP involved. I hope it works out. .post back with results but you do realise you can just reapply to reaffirm all points. A 10 day wait and it'll be all done. But again, time effort and the wasted ££

We had a beautiful wedding..Mother in law watched us via facetime. Had no choice and we did what we could. It's horrible to be rejected when in all innocence you just want your family with you WITH BEST interests.

My MIL doesn't work, doesn't own her home but we addressed the refusal with EVIDENCE. Search my posts by clicking my name to see the doc list I provided. It wasn't much but it was simply enough with the cover letter. Including a very strongly worded paragraph about the inhumane hostile environment and how we would NEVER let her overstay!! Best of Luck. God has a plan for all. Simply not the time for your mama to come..it'll be soon x
