Tier 2 dependant applying separately for ILR

Post by mrshahy » Thu Jan 18, 2018 9:10 pm

Hi, I got ILR last year after spending 5 years on Tier 2 (General) visa. My wife currently has Tier 2 dependant visa which was initially issued in 2012 and then extended in 2015 in the same category (at the time I also had Tier 2 visa).

My wife will be applying for ILR too and I'm reading the SET(O) form and need advise whether the following sections (e.g 5.6 and 12) are applicable here as my wife currently isn't working. As these questions are about the finances, I'm currently working and supporting my family finances etc.

  • Section 5.6 You must complete all 5 boxes below if you are applying as a work permit holder, a Tier 2 (General), Tier 2 (Sports Person) or a Tier 2 (Intra company transfer) migrant (your employer will be able to provide you with these details).
  • Section 12 Documents > Your Finances
For all applicants except those applying in the bereaved partner category.
Evidence of your finances. If you have to complete section 5, bank statements, building society savings book(s), pay slips or other formal documents as evidence of your ability to maintain and accommodate yourself and any dependants without recourse to public funds. (See Note 4).
Thanks in advance

5.6 doesn't apply because she is a PBS dependant and not a Work permit holder nor a PBS migrant.

12 If you are providing support, then she should include your details.
Note 4 wrote:....If you claim that a relative or friend is providing you with financial support (see question 5.4), in addition to evidence of your own financials, you must provide bank statements or other documents of the kind described above as evidence of their financial resources. The documents showing the financials available to you and to any person supporting you should cover at least the last three months.

Hi Vinny,

Thanks for your response.

Regarding section 5.4, does it apply to her? It has two options to choose from, Yes & No, if you chose Yes then you have to answer the following:
  • If so, how much do you receive each month? [£ ]
However, she doesn't regularly receive money from me, I just pay the bills etc. So it seems that it may imply to friends or other relatives?

Also, in section 12, it seems to suggest to only fill this if you have chosen section 5 (e.g. the SOC & salary section) which in this case I have omitted.
Your Finances
For all applicants except those applying in the bereaved partner category.
Evidence of your finances. If you have to complete section 5, bank statements, building society savings book(s), pay slips or other formal documents as evidence of your ability to maintain and accommodate yourself and any dependants without recourse to public funds. (See Note 4).
Thanks in advance

P.S: Congrats mspr335. I guess it wouldn't hurt if I include my statements. I just want to understand if this section is mandatory for dependants.

Dependant ILR documents checklist

Post by mrshahy » Tue Jan 30, 2018 8:36 pm

I got my ILR last year and my wife, who's been living in the UK with me for more than 5 years (as a Tier 2 dependant), will be applying for ILR this month/week. She's currently not working.

Do I need to include the following?
  • Marriage certificate
  • My passport / BRP
  • Finance (My Bank Statements/Payslips?)
  • Is there a minimum monthly saving requirement in my bank account as I'm supporting my family (mortgage etc)?
Also this page says:
You must also have been living with your partner in the UK for at least:
  • 2 years if you applied for your current visa before 9 July 2012
  • 5 years if you applied for your current visa on or after 9 July 2012
What evidence do I need to show for this?

Thanks

sorry about that, for some reason, I couldn't find my previous post (I thought it would appear in the control panel but it doesn't have the option to show my posts)
