Permanent Residence or ILR?

Post by Asarhia » Tue Feb 19, 2019 6:59 pm

Hello,

I'm in Italian citizen who has been living and working full-time in the UK since 2005. In 2016 I applied for permanent residence and received my permanent residence card in October 2017. I am now planning to apply for settled status this week, and then apply for naturalisation on 30th March.

I was planning on using my permanent residence card as supporting evidence for the application (by entering its details in section 2.4).

My questions are:
1) Is there any benefit in using the ILR (via settled status) in section 1.3 instead, assuming the decision is made before 30th March? If I understand correctly, you need to have held permanent residence for at least 12 months, but ILR can be used from the day it's granted.

2) What date do I need to prove that I was in the UK? Is it 31st March 2014 (5 years before the naturalisation application) or some other date, like the 31st March 2013 (5 years + 1 before the application, as I'm an EEA citizen exercising treaty rights) or something else?

Thanks!

PR is the same as settled status if you are applying for citizenship before Brexit. So skip the step you plan for next week. Directly apply for citizenship.
You have to prove 5 years prior to date of application. If you apply on 30th March, you should be in the country on 31st March 2014

You have alreadey held PR card for more than 12 months. Therefore go straight for AN application.
If you get Settled Status ("ILR") you will have to wait 12 months from issue - so your understanding is not correct.
