Child Born in UK but living abroad

Hello,

I have a few questions regarding registering my child using MN1 form from abroad. I went through this forum and saw a few post but so far have not seen any replies as to whether their children were registered successfully or denied.

My situation

I obtained my PR in 2016 and subsequently British citizenship in 2017.

My child was born in UK (2014) but moved in with grandparents who are living abroad after my maternity leave ended. Now we are living abroad together because my husband was made redundant in the UK and got a job offer in his home country instead.

My husband (EEA National) moved to the UK in 2008 but only registered himself in 2011 and obtained his PR in 2016


My question

a) I read in the notes that it is possible to apply from abroad but am not too sure if it will be rejected as the child is currently living abroad.

b) Section 2 (Residence) states that we must list residence in the UK or British Overseas but we no longer have a UK address except for the flat that is now being rented out.

c) Section 5 (Referee); can the school that my child is attending now be a referee?

d) Will the application be rejected just because the parents and child are currently living abroad and not in the UK?

I would like to know what others have gone through before I spend £1012 for the application.

A UK born child is entitled to register as British once either parent is granted ILR or PR. Living abroad does not mean the child loses this entitlement register.

However note that your husbands PR will lapse if he is or has been absent from the UK for 2 or more years.

Looking through the entire form, looks like I only have to fill Section 1, 4, 5, 6, 7 and 8 for children born in the UK.

Yea he knows that so we plan to go back every year for a couple of days. Don't know if that helps.

I am only worried that after sending in my child's application, they might reject the registration and we lose the £1012 fee.

Note that short 'visits' to the UK don't necessarily maintain the PR status and with Brexit looming and the new settlement scheme for EU nationals, I would suggest you decide what is priority in terms of being able to live in the UK again.
I am only worried that after sending in my child's application, they might reject the registration and we lose the £1012 fee.
No reason it should be rejected. Note that you might have to provide evidence of the exercising treaty rights at the time of the childs birth, so hopefully you have retained all the paperwork.

Thank you for your quick reply.

I only have a certified copy of my BRP and my British passport. I have chuck all my bank statements away and only kept important P60s, P45 for us both.

We definitely want to go back to UK again but hard to say when as at the moment he has quite a good job here
