Application for Tier 2 ICT visa post serving cooling off period

Hi,

I was working in UK under tier 2 ICT long term visa last year and currently serving cooling off period. Below are my previous travel details and questions:

My previous travel details:
UK Tier 2 ICT LT visa start date: 1st July 2017
UK Tier 2 ICT LT visa end date: 16th July 2018
UK project end date and return travel to India permanently: 30th April 2018

I have letter from my UK employer about the last working day in UK as well as travel ticket to India and stamp on passport at Mumbai airport on departure as 30th April 2018. I have never been to UK since then. Also, I have letter from my current employer in India with employment start date as 1st May 2018.

Now, as per project requirement, I need to travel to UK again for same client as well as UK employer under Tier 2 ICT LT visa category for 18 months. Below are my questions:

1. When is the earliest date that I can travel again to UK after cooling off period? 1st May 2019 or 16th July 2019?

2. If I am eligible to travel on 1st May 2019, can I get UK Tier 2 ICT LT visa for more than a year duration as my project requirement is 18 months?

3. If I am eligible to travel on 1st May 2019, and my current employer agrees to provide visa only for one year, can I apply from UK for extension from UK while I will be in UK?

4. If my wife is coming with me on dependent visa category, can she work in UK as well?

The earliest you may apply for a fresh entry clearance visa is after the 12 months cool-off period, which in your case should be 1st May
You may extend your stay in the UK your employer willing
Yes, your wife can work on a dependent visa

Can I get 18 month visa when I will apply for the same on 1st May or there is restriction that I will get only 1 year visa and then I have to come back?

Depends on for what duration your employer raises a COS for your case
There is no 1 year limit set by UK home office

Hi Poper,

My employer is not ready to process my visa on 1st May with below reason:

"We will start application from July end instead of 1st May to restart your 24 months clock by observing the 15 months cooling period."

Is it fair statement by my employer? If yes, in which context?

Your visa application should be made only 12 months after cool off period. This is the key
