Applying for UK Citizenship or Passport

Post by kelliesamuel » Mon May 27, 2019 12:13 pm

Hi,

I'm an Australian-born (1994) citizen currently on a tier 5 mobility scheme visa, which lasts 2 years and expiring Feb 2019.

I am looking to remain in the UK for the foreseeable future and I'm currently considering the available options.

1) Applying for British citizenship

My mother was born in the UK in 1963 to British parents, and migrated to Australia in 1968. My father is Australian. I am wondering if I am eligible to obtain a British passport as my mother was born here. I think I might be as the UK gov websites states:

"Your British parent could pass on their citizenship to you if they were one of the following:
born or adopted in the UK "

However, I can not be completely sure and there is no link to applying on the website (https://www.gov.uk/apply-citizenship-br ... 3-and-2006). There is a link to applying for citizenship if my father was British, but not the other way around.

    2) Applying for a British Passport

As above. I am unsure on the difference between obtaining a passport and British citizenship, and whether one is a easier to obtain.

    3) Ancestry visa.

I know I am eligible for an ancestry visa, but this would require me to return home after my current visa expires to begin a new application to return. This is my least preferred option.

PLease feel free to ask anymore questions about my situation.

    Thanks in advance,

    Kellie

As your mother was born in the UK before 1983, she is a British citizen otherwise than by descent. That makes your siblings and you British citizens by descent.

You can apply directly for a British passport with your mother's British birth certificate, your parents' marriage certificate and your birth certificate.
