Submitting application date (5 years period)

Post by Hec955 » Tue May 28, 2019 4:46 pm

Dear members,

Thank you for providing information all this time for people going through citizenship application.

I would like to ask a question regarding my partner's application for BC.

She is an EU citizen with PR acquired in 2017. Since 2012 she is working full time and we've got all the evidence for that. As we are in the process of finalizing her application we would like to know if she needed to be in the UK 5 years ago.

For example if she sends her application tomorrow, does she need to be physically in the UK 5 years ago (i.e 29/05/2014) or doesn't matter? The reason asking is because she was on annual leave from work (for 2 weeks went abroad) between 30/05/2014-14/06/2014. Can we send her application within these dates 5 years from that time(30/05/2019-14/06/2019)?

Thank you very much in advance!

Yes, this is a mandatory requirement that she must have been physically present in the UK on the same date 5 years ago as the date she applies. She should not apply if she was not present in the UK. She risks being refused and will lose her fee paid.

Are you married to (or in a civil partnership with) your partner, and are you a British citizen?

If so, she could apply as the spouse of a British citizen for which the residency requirement is 3 years, so she would need to have been in the UK exactly 3 years to the day on the day she applies.
