Advice on MN1 Online application

Advice on MN1 Online application

Hi All,

Thank you for such an informative discussion board!

I would like to know if I am making the correct selection on the online "Child registration for British Citizenship".
As there is no place to state under which section you are applying (my son falls into Section 3(5)) - the following selections are available:

1. Your parent is British by descent and lived in the UK or a British Overseas territory for at least 3 years before you were born
2. Your parent is British by descent and you and your parents (unless they are legally separated) are now living in the UK or a British Overseas territory
3. You were born on or after 13 January 2010 and your parent was serving in the UK armed forces
4. You were adopted abroad by British citizen parents
5. You were born before 1 July 2006 to a British father and your parents were not married
6. One or both of your parents is applying for British citizenship
7. Other - apply at the discretion of the Home Secretary

I have chosen No.2, as this fits our description perfectly. Is this correct? As in does it correlate with Section 3 (5)?
Also, the list of required documents asks for "Evidence that childs British parent lived in the UK for a period of 3 years at some time before childs birth" - why would this be a requirement when the family has been living in the UK for 3 years prior to application as requested?

Next it asks "Are you settled in the UK" and the answer is no - he does not have ILR or settled status (on a dependant visa for 4.5 years now), will this affect the application negatively?

Not many members are familiar with Section 3(5) or 3(2) registrations and you have provided limited information as well.

I asked another moderator who is familiar with these sections to have a look at your thread a few days ago. He must be busy otherwise I am sure he would have responded to you.

No 2. is indeed the correct choice for a Section 3(5) application.

It is possible that a child may have more than one basis for registration as a British citizen and the form is designed to collect as much information as possible for the caseworker to analyse and decide which Section of the British Nationality Act 1981 should be applied. That is why it does not ask the applicant which Section to apply under.

No. So long as the requirements for Section 3(5) are met, the registration is an entitlement and can't be refused except on good character requirements.

Again, this is a catch-all question. Settlement is relevant for some registration applications.
