I have a cousin who has applied for NHS job as a doctor. she was given a tier 2 visa, CoS for 2 years and now has collected her BRP in Dec as well. She was supposed to start in Jan 2019, but due to change of circumstances, she had to delay her joining till July 2019. She had informed her HR at her NHS trust, and they said it was ok and she can join in July.
She was just about to start her journey tomorrow, when the NHS HR told her just 2 days before her travelling, that she cannot join nor enter UK as her Tier 2 visa is no more valid because she did not join her work within 28 days of collecting her BRP.
In her defence, she went straight to the hospital the day after she collected BRP and informed her that she cannot join till July, and they said that is fine. She kept emailing them, informing them of her confirmed start date. She is in contact with her consultant who has prepared her rota to start her work next week.
Now she has been told she is not joining and cannot apply to join until Jan 2020 cooling off period.
Can anyone advise on what can she do? Was it her responsibility to inform the home office of her delay in starting work? Shouldnt that have been HR's job as she is an international immigrant and knows nothing about immigration laws of UK, whereas HR should be dealing with many such queries on a daily basis.
