Baby born outside UK to ILR Father who is now British

Post by mdahar22 » Mon Jul 22, 2019 12:44 am

Hi there,

I have 2 babies who were born in South Africa. At the time of my first baby's birth in March 2016, I had ILR and had applied for british citizenship (naturalised in May 2016). My second baby was born in October 2018 while I had British citizenship.

Are both the kids entitled to British citizenship and I can apply for British passports for them?

Thanks for your help.

Your first child will follow the immigration path of the less privileged parent. It is expected for the child to hold ILR and can only be registered for British citizenship via MN1 when the other parent is also applying to become British at the same time (or is already British). The second child is British at birth and so you can apply for a British passport directly.
