Citizenship for child and adult dependants born outside UK

Post by shaz2019 » Thu Jun 27, 2019 10:13 pm

Hi,
My and my family's immigration history is as follows

I received my ILR in March 2018 after 5 years on Tier 1 Entrepreneur and my British citizenship in June 2019.
My family received their ILR in June 2019 after 5 years on tier 1 dependants visas.

I am confused as to when I can apply for their citizenship as I asked a solicitor and he said I have to wait 1 year after ILR as I did, but my understanding was I could immediately apply because now I am a British citizen.

In my family other than my wife I have 2 children below 12 years, 1 child 17 years and 1 son who is an adult now at 20 years old. All are born outside the UK.

I hope someone can guide me that I should apply for their citizenship now or later as it will cost me a lot in fees if it is too early to apply.

Your spouse and children under the age of 18 can apply now if your spouse meets the requirements.

Your 20 year old will need ILR for 12 months before he can apply on form AN.

Thanks CR001 for your reply and advice.

I was looking at the guidance and what i understood is that my wife can apply immediately and the children have to be born in the UK or been born when I was British to apply now.

Please can you further clear this up and also can you advise as to what forms are needed to apply.

Thanks.

They can ALL apply now. You are not reading or understanding the guidance properly. Children are registered under section 3(1), which is at discretion. They simply need ILR and one parent applying or already British and the other parent holding ILR.

Form AN for your spouse and MN1 for children.
