Tier 2 General - passport expiring - BRP replacement

Post by doraramu84 » Fri Oct 11, 2019 1:48 pm

Hi,

I am currently in Tier 2 visa.

My visa is valid from 18-Apr-2015 and valid until 17-May-2020. No BRP card given at the time my visa was issued. It was stamped on my passport.
My Passport is valid until 06-Apr-2020.

As per my understanding I can apply for my ILR after 21-Mar-2020.

So, I am looking to renew my passport now.

I have couple of queries.

1. Once I get my new passport, should I transfer my visa to BRP?
2. The gov.uk website says I need to do this if I have to prove my right of work. what does it mean? Do I need to prove my right of work at the time I apply my ILR?
3. Do I need to inform my employer when I get my new passport (as my visa will be in my old passport and it can prove right of work)?
4. I am planning to travel to India in December. Will I be able to travel with my old passport and new passport in case I dont get my visa transferred to BRP by then?

Thanks,
Radha

Visa remains valid even if it is in an expired passport. Up to you if you want to get a BRP. It could take 6 months
2. The gov.uk website says I need to do this if I have to prove my right of work. what does it mean? Do I need to prove my right of work at the time I apply my ILR?
No. Right to work checks are only needed for people who are want to start a new job. They must have a BRP. This technically is irrelevant for a sponsored Tier 2 visa holder. Your are already employed and your right to work for an employer is implicit by the virtue of sponsorship and Tier 2 visa
3. Do I need to inform my employer when I get my new passport (as my visa will be in my old passport and it can prove right of work)?
No this is not relevant to your employer
4. I am planning to travel to India in December. Will I be able to travel with my old passport and new passport in case I dont get my visa transferred to BRP by then?
Yes
