Hi all

I have fallen fowel of the RoA and right to work confusion... I was told I can travel in and out of the UK on my nz passport as long as I had an old passport with my RoA certificate in it. This meant I assumed that it would work the same as proof for Right to Work... No it doesn't...

I left a good job to go to a new one and after two days of working I was asked to stop working as my passport didn't have the RoA certificate in it as it was in an expired passport....
I am now unable to work even though I have spoken to an immigration lawyer who confirmed i still have the right to work in the UK.. I just lost the proof to prove it until my passport gets back from the home Office..... I am currently struggling with dwp to get my rent paid etc as they too are questioning my status

Anyway... does anyone have any up to date information on how long the renewal process is taking? I know it says 6 months but I'm hoping it will be a lot sooner as I need to get back to work asap....

You may contact them and request the return of supporting documents for your application. This normally won't take them more than 2 weeks to dispatch and may even help by forcing the relevant department to progress with case creation stage...
The OP doesn't have a valid right to work document. ROA expires when the passport does and has to be renewed each time. Getting documents back isn't going to help the OP.

True that CR001, technically it is as you said. However, proving pre-existing ROA and a proof of application for renewal, should suffice as proof similar to the 3c leave to remain provision for visa applications.

Section 3C does not apply to applications under the Nationality Laws. ROA is nationality not immigration rules. No current valid RoA on a passport = no document to prove right to work.

Hello All,
I wonder if anyone has received CoE-RoA quicker than 2 months as stated in one of the post earlier. It is very difficult to understand such long processing time for an application which is probably easy to judge.
I have recently applied for my Son's RoA, he was born here in UK in June. At the time of his birth both of us me and my wife had ILR so it should not take long to decide on the application because all they need to check is date of birth and our residency status at the time of birth. Yet the current duration is well above 4 months.

Does anybody know why this application can't be made in person to get it quickly?

Thanks
Jayesh

I am still sorting this out and waiting.... turns out the Job Centre are now questioning my status and are holding up payments even though my partner and my two kids have British passports.. I ended up going to the local MPs office and they had a magic direct dial number to the home office!! They have requested that it gets processed asap.... they even said they are happy to confirm that I have the right to work if an employer would like to ring them at the MPs office.....
No passport back yet...... waiting.....
On a positive I hopefully will be in employment again Next week!! But it's not helping me with the loss of earnings which has been 6 weeks now and no money...
Hardest time I've ever had to endure... no food, no rent paid, no bus fair for my son To get to college.... It's crazy

Hi!

I've been in the UK for 18 years and stupidly relied on my ROA, rather than get UK citizenship. Anyway, I had to renew my passport and hence ROA. It's only been a month but I'm trying to apply for a mortgage and cannot without my valid passport and ROA. I'm also travelling back to Oz for Xmas to see my family.
I've seen your post and wondering if you could share how you contacted the home office to speed up application? I'm desperate!!!

Thanks

Hi everyone,

Just want to know if anyone requested their documents back recently. I have applied for my Son's ROA recently and provided mine and my wife's original passport and BRP as supporting documents. Looking at the current processing time of well over 4 months. i think it will be a good option to request the documents back without withdrawing application in case we have to travel back home urgently for any reason.

Has anyone done this and had it impacted their application processing time in anyway?

Thanks
Jayesh

Hi
I'm still waiting for my passport to get back with my RoA. It's only been 5 weeks since it arrived with the home Office. The MP wouldn't give me a number for the home Office and rang them for me. They were asked to process it faster if possible. Will keep you posted on how long it took once it arrives.

I'm still out of work and fighting to get wages owed paid out to me. Even having problems with the job Centre questioning my rights and have just been refused benefits which I'm now fighting for contribution based JSA which I'm entitled to because I've worked 20+ years in the UK.

It's beaucratic bull$#!t which needs sorting !!!

SunnyBee, glad to know that you got your passport back with ROA. In recent times your seems to be the quickest turn around. May be the call for MP was the reason or the processing times have been improved. We will find out if someone else get theirs in similar timescales or quicker. Good luck with your future endeavours.

SunnyBee congrats on getting your passport and ROA back within a short period of time. The whole process is a complete joke. I'm going to contact my MP to see what magic he can do.
Good luck and best wishes.

Dear All,

I have applied to RENEW my right of abode in my new AUS Passport that I got this year as the other was coming to expiration. I applied in July 2019 and have yet to receive any response or email from them. All I got by way of confirmation was that my package of documents had been delivered and signed for at UKVI.

However, I have not yet heard anything since... does anyone have any update on processing times for a renewal of right of abode this year?

Is it normal not to get any formal confirmation email from them?

I also have not been asked to submit biometrics but this may be because I submitted them previously with the previous right of abode.. has anyone that has renewed their right of abode been asked for biometrics again?

Any updates would be greatly appreciated!

Erik

Hi All,

Just an update from my side. I requested them to return my documents because I need to travel urgently. They state on the website that the documents will be returned with in 10 working days and it's been 10 days. I was about to send another request today however just got a call from UKVI stating that my application is still in queue and hasn't been allocated to caseworker yet but if I can provide evidence of urgency for travel then they will try and expedite the process of ROA.

Thanks

Hi all,

Just an update from my end. I did email the proof for urgency of travel to UKVI. Since then they contacted me to say that they are satisfied with evidence provided and will expedite my Son's ROA application.
I received all my documents including my son's passport with COE for ROA in it on Saturday 26th. It took just over 5 weeks to get this.

Hope it is helpful to someone.

Thanks and Good Luck all.

hi guys. it has been more than 6 months - husband's app submitted end of Apr 19 ( ROA on expired ppt valid till 6 Jan 2020) and my husband managed to call the ukvi last Thurs and they shut him down by sending him an email to tell him that they will contact him as soon as they are in a position to take a decision on his case and not to contact them agAin unless a change in circumstances. the thing is my spouse visa is due for extension in Dec 2019. wrote to MP and also sent a letter to UKVI. any idea what else could be done? apart from hoping for a miracle to happen.

Hi all, quick update. Husband finally received his passport with COE- ROA in it today. Not sure if the MP was involved or the urgency I mentioned in my letter to UKVI. For those applying you may quote The Immigration (Certificate of Entitlement to Right of Abode in the United Kingdom) Regulations 2006. They set the rules but no idea why they need to wait after 6 months to approve 1 application. That's 4.5 years sorted... Good luck to all.

Hi All

I put my renewal application in on 21 July 2019. I asked for my passport back in August as I needed it for ID, received it 3 days later (with all my original documents) then sent it back within the week as the letter stated the application would not be processed without it. I received the passport back yesterday with my new CoE- RoA in it. Just short of 4 months which seems to be quick but I have no necessity to do biometrics.

Hi everyone,

I've been in the UK coming to 3 years now. I was on a student visa for 2 years and am currently on a tier 2 work visa. I decided to apply for my ROA in July this year before my tier 2 visa runs out. Its been almost 4 months since my application and have not heard anything, I have not even been asked for my biometrics. I tried calling the home office about 3 weeks ago and the person on the line was of no help, he told me the same information stated on the home office website. I have booked my flight to go home to Singapore for Christmas in December and I'm worried I won't be able to make it home this year:(

Does anyone know when we would or if we are even asked to do biometrics? I tried to use the case Id given to track my application but I can't seem to find a place to track it.

I'm going to try calling again to see if I can find out if my application has even been looked at.

Any advice would be greatly appreciated!

Thanks,
Andrea

My mum and grandmother are English and thus I do qualify for ROA. I applied for ROA so I don't have to keep applying for visas to work in the UK. When I came to the UK to study I was not aware of this visa and when I applied for work immediately after my degree I did not have the ability to live in the UK and not be able to work. So I applied for it now as my work visa is coming to an end.

I was born in Singapore in 1990. I was adviced by the home office that because my mum is English and had a UK passport and my grandmother is English I am able to apply for ROA.

When I came to the UK to study I was not aware of this visa and when I applied for work immediately after my degree I did not have the ability to live in the UK and not be able to work. So I applied for it now as my work visa is coming to an end.
If your mum is UK born, were you born abroad before 1 January 1983?
I was born in Singapore in 1990. I was adviced by the home office that because my mum is English and had a UK passport and my grandmother is English I am able to apply for ROA.
Was your mum born IN the UK or abroad?

You are likely British by descent and can apply for a British passport directly.
