Application Eligibility

Post by Shadyoakedive » Sun Apr 26, 2020 4:08 pm

Hi All,

I started work in the UK on 21/09/2015.

As I was on a Tier 4 visa before that, I converted it to a Tier 2 visa in-country. My 1st Tier 2 BRP had the date of issue as 10-08-2015. I then left the UK on 17-08-2015 for 3 weeks before coming back to start work.

I understand that I am allowed to apply for the 5-year ILR 28 days before I hit the 60 months qualifying period. My question is, does my qualifying period start on the 10-08-2015 as I was already in the UK on this date?

Thanks

Your qualifying period starts from the date your tier 2 visa was issued.

Employer letter confirmation appropriate rate of salary

Post by Shadyoakedive » Fri Jul 10, 2020 8:37 pm

Hi guys,

I am about to submit my ILR application but just realised that at the document page, there is a requirement for the employer letter to provide "confirmation that this (Salary) is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors. (See note 8 below)"

Now I did not realise that this was needed as my letter already contains my current Salary and SOC code, and my salary is above the experienced worker rate of the SOC code / the £35.8k requirement for the ILR. My letter also has the "foreseeable future" working on it.

Has anyone here submitted a letter without that? I could ask for another letter from my employer but it takes a bit of time as the head office is based overseas and they have a policy for all signed letters to go through a signatory...

Thanks!

Confirmation of SOC and salary is enough

Thanks!

That would make sense as surely the caseworker will know what the min salary requirement is per SOC code.
