I am on ILR, Wife still on ICT dependent, any issues in travel till she is moved to ILR dependant?

Post by pradeeptheboss » Wed Nov 11, 2020 11:54 am

Hi All,

I was on Tier 2 ICT, long term staff and have recently been granted ILR in the 10 year long resident route.

My wife is still on previous grant of leave as Tier 2 ICT Dependent and her visa is active till March'21. We need to travel to India and planning to return by Jan and then apply for her ILR Spouse Dependent visa.

Will there be any problems if we travel now since her visa has not been transitioned to ILR dependent yet? Can we only travel once she is on ILR spouse dependent visa?

Thanks in advance

Without converting her into the dependant of settled person that travelling manoeuvre will be risky.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

She could be refused entry at the UK border as her visa is not valid for admission as you applied under SET(LR). She is advised to either apply for a new entry clearance from India or switch to FLR(M) here before travel
