I await ILR but employer asking must sight BRP

Hi need help!

Can I apply for a job while awaiting ILR as I thought this was fine. It is a spouse ILR and to my shock I applied to a company but the guy won’t let me because I haven’t got BRP. I explained that I await my ILR application and showed him references for employers to check RTW (right to work) but he insisted company policy he has to sight BRP which I don’t believe.

Just to check one can still search to work while awaiting ILR right!?? This is not a tier 2 this is spouse route

Please help I need to work urgently!!!

Understandable. However, they may use the Employer Checking Service?

Thanks, do employers get the check response immediately?
As that would be much better than them having to wait for response from OH
