Urgent overstaying query -Fiancé visa to Spouse

Hi all,

Hoping for some clarification around the issue of overstaying a visa.

My partner (then fiancé) came over in December 2020 on a fiancé visa and after some changes to our appointments giving notice (due to covid) we subsequently married in early May 2021.

We are now applying/applied for our Spouse visa.

We have completed the online form, payed the fee and payed the IHS fee, and now need to book a biometric appointment. My wife's visa runs out in less than a weeks time (25th may) and we cannot find an appropriate biometric appointment during this time.

If the biometric appointment we book is after the 25th May, would this be classed as overstaying? (Given we have submitted the online application, and payed the appropriate fees.)

The date of application is the date you submit and pay online and not the date of your biomtric appointment.
